국토의 계획 및 이용에 관한 법률 시행령 제61조(도시ㆍ군계획시설부지에서의 개발행위)

1. 지상ㆍ수상ㆍ공중ㆍ수중 또는 지하에 일정한 공간적 범위를 정하여 도시ㆍ군계획시설이 결정되어 있고, 그 도시ㆍ군계획시설의 설치ㆍ이용 및 장래의 확장 가능성에 지장이 없는 범위에서 도시ㆍ군계획시설이 아닌 건축물 또는 공작물을 그 도시ㆍ군계획시설인 건축물 또는 공작물의 부지에 설치하는 경우

2. 도시ㆍ군계획시설과 도시ㆍ군계획시설이 아닌 시설을 같은 건축물안에 설치한 경우(법률 제6243호 도시계획법개정법률에 의하여 개정되기 전에 설치한 경우를 말한다)로서 법 제88조의 규정에 의한 실시계획인가를 받아 다음 각목의 어느 하나에 해당하는 경우

4. 도시ㆍ군계획시설의 설치ㆍ이용 및 장래의 확장 가능성에 지장이 없는 범위에서 「재생에너지 개발ㆍ이용ㆍ보급 촉진법」 제2조제3호에 따른 재생에너지 설비 중 태양에너지 설비 또는 「수소경제 육성 및 수소 안전관리에 관한 법률」 제2조제6호에 따른 연료전지를 설치하는 경우
