근로기준법 시행령 제23조의6(3개월분 임금ㆍ체불횟수 산정 등)

① 법 제43조의4제1항제1호에 따른 3개월분 임금은 「고용보험 및 산업재해보상보험의 보험료징수 등에 관한 법률」 제16조의3제2항에 따라 산정된 월평균보수의 3개월분으로 하되, 월평균보수의 산정이 곤란한 경우에는 고용노동부장관이 정하여 고시하는 방법에 따라 산정한 월보수액의 3개월분으로 한다.
