Article 14 (Operation of Associations)
① 법 제36조제4항, 제37조 및 제38조에 따라 우리사주를 배정하거나 법 제39조에 따라 우리사주매수선택권(이하 "우리사주매수선택권"이라 한다)을 부여하는 경우에는 저소득 근로자 및 장기근속 근로자를 우대하여야 한다.
(1) When employee stock is allotted under Article 36 (4), 37, or 38 of the Act, or employee stock purchase options (hereinafter referred to as "employee stock purchase options") are granted under Article 39 of the Act, low-income workers and long-serving workers shall be given preferential treatment.
② 조합은 법 제36조제1항제1호의 재원으로 취득한 우리사주를 그 재원의 출연자와의 약정을 통하여 다음 각 호의 어느 하나에 해당하는 조합원에게 우선적으로 배정할 수 있다. <신설 2016.1.19>
(2) Through an agreement with the persons who contributed the resources, the association may preferentially allot employee stock acquired with the resources under Article 36 (1) 1 of the Act to members who fall under any of the following:
1. 장기근속 우수인력에 해당하는 조합원
1. Members who are excellent long-serving personnel;
2. 회사의 설립, 경영 및 기술혁신 등에 기여하였거나 기여할 수 있는 조합원
2. Members who have contributed, or can contribute, to the establishment, management, technological innovation, etc. of the company;
3. 그 밖에 회사의 생산성ㆍ매출액 증가 등에 기여한 조합원
3. Other members who have contributed to increases in the company's productivity, sales, etc.
③ 법 제39조에 따라 우리사주매수선택권을 부여하는 경우로서 다음 각 호의 어느 하나에 해당하는 경우에는 해당 조합원에게 우리사주매수선택권을 우선적으로 부여할 수 있다. <신설 2014.7.28, 2016.1.19>
(3) Where employee stock purchase options are granted under Article 39 of the Act, they may be preferentially granted to the members concerned in any of the following cases:
1. 우수인력의 장기근속을 장려하기 위한 경우
1. To encourage excellent personnel to stay with the company for a long time;
2. 회사의 설립, 경영 및 기술혁신 등에 기여하거나 기여할 수 있는 경우
2. Where the members have contributed, or can contribute, to the establishment, management, technological innovation, etc. of the company;
3. 그 밖에 회사의 생산성ㆍ매출액의 증가 등에 기여한 경우로서 우리사주제도 실시회사와 우리사주조합이 제13조제1항에 따른 우리사주운영위원회에서 협의한 경우
3. Other cases where the members have contributed to increases in the company's productivity, sales, etc., and the company operating the employee stock ownership system and the employee stock ownership association have consulted on the matter in the employee stock ownership operation committee under Article 13 (1).
④ 조합의 회계연도는 해당 우리사주제도 실시회사의 회계연도에 따른다. <개정 2014.7.28, 2016.1.19>
(4) The fiscal year of the association shall follow the fiscal year of the company operating the employee stock ownership system concerned.
