Road Act, Article 48 (Designation of Motorways)

① 도로관리청은 다음 각 호의 어느 하나에 해당하는 경우에는 대통령령으로 정하는 바에 따라 자동차전용도로 또는 전용구역(이하 "자동차전용도로"라 한다)을 지정할 수 있다. 이 경우 자동차전용도로로 지정하려는 도로에 둘 이상의 도로관리청이 있으면 관계되는 도로관리청이 공동으로 자동차전용도로를 지정하여야 한다. <개정 2023.8.16>

1. 도로의 교통량이 현저히 증가하여 차량(「자동차관리법」 제2조제1호에 따른 자동차 및 같은 조 제1호의3에 따른 자율주행자동차와 「건설기계관리법」 제2조제1항제1호에 따른 건설기계를 말한다. 이하 같다)의 능률적인 운행에 지장이 있는 경우

② 도로관리청이 제1항에 따라 자동차전용도로를 지정할 때에는 해당 구간을 연결하는 일반 교통용의 다른 도로가 있어야 한다.

⑤ 자동차전용도로의 구조 및 시설기준 등 자동차전용도로의 지정에 필요한 사항은 국토교통부령으로 정한다.
