도시 및 주거환경정비법 시행령 제23조(사업대행의 완료)

① 사업대행자는 법 제28조제1항 각 호의 사업대행의 원인이 된 사유가 없어지거나 법 제88조제1항에 따른 등기를 완료한 때에는 사업대행을 완료하여야 한다. 이 경우 시장ㆍ군수등이 아닌 사업대행자는 미리 시장ㆍ군수등에게 사업대행을 완료할 뜻을 보고하여야 한다.

② 시장ㆍ군수등은 제1항에 따라 사업대행을 완료한 때에는 제22조제1항 각 호의 사항과 사업대행완료일을 해당 지방자치단체의 공보등에 고시하고, 토지등소유자 및 사업시행자에게 각각 통지하여야 한다.

③ 사업대행자는 제2항에 따른 사업대행완료의 고시가 있은 때에는 지체없이 사업시행자에게 업무를 인계하여야 하며, 사업시행자는 정당한 사유가 없는 한 이를 인수하여야 한다.

④ 제3항에 따른 인계ㆍ인수가 완료된 때에는 사업대행자가 정비사업을 대행할 때 취득하거나 부담한 권리와 의무는 사업시행자에게 승계된다.

⑤ 사업대행자는 제1항에 따른 사업대행의 완료 후 사업시행자에게 보수 또는 비용의 상환을 청구할 때에 그 보수 또는 비용을 지출한 날 이후의 이자를 청구할 수 있다.
