병역법 시행령 제46조(전환복무기간 만료자의 전역)

① 경찰청장, 소방청장 또는 해양경찰청장은 의무소방원 또는 의무경찰대원으로서 전환복무 기간이 만료될 사람의 명단을 전환복무기간이 만료되는 달의 전달 15일까지 국방부장관에게 통보하여야 한다. <개정 2014.11.19, 2015.11.20, 2016.11.29, 2017.7.26>

② 국방부장관은 제1항에 따른 통보를 받으면 전환복무기간이 만료되는 날에 전환복무를 해제하고 예비역에 편입하되, 전역일 10일 전까지 그 명단을 경찰청장, 소방청장 또는 해양경찰청장과 지방병무청장에게 통보하여야 한다. <개정 2014.11.19, 2016.11.29, 2017.7.26>

③ 국방부장관은 제2항에 따라 예비역에 편입된 사람에 대해서는 「의무소방대 설치법 시행령」 또는 「의무경찰대 설치 및 운영에 관한 법률 시행령」에 따라 부여된 계급에 따라 다음 각 호와 같이 군의 계급을 부여한다. <개정 2015.11.20, 2016.11.29, 2017.9.22>

④ 국방부장관은 제43조, 제45조 및 이 조 제2항에 따른 전환복무, 전환복무 해제, 병역처분변경 및 전환복무기간 만료자의 예비역 편입 등에 관한 권한을 각 군 참모총장 또는 소속 군부대의 장에게 위임할 수 있다. <개정 2017.9.22>
