부정청탁 및 금품등 수수의 금지에 관한 법률 제22조(벌칙)

1. 제8조제1항을 위반한 공직자등(제11조에 따라 준용되는 공무수행사인을 포함한다). 다만, 제9조제1항ㆍ제2항 또는 제6항에 따라 신고하거나 그 수수 금지 금품등을 반환 또는 인도하거나 거부의 의사를 표시한 공직자등은 제외한다.

2. 자신의 배우자가 제8조제4항을 위반하여 같은 조 제1항에 따른 수수 금지 금품등을 받거나 요구하거나 제공받기로 약속한 사실을 알고도 제9조제1항제2호 또는 같은 조 제6항에 따라 신고하지 아니한 공직자등(제11조에 따라 준용되는 공무수행사인을 포함한다). 다만, 공직자등 또는 배우자가 제9조제2항에 따라 수수 금지 금품등을 반환 또는 인도하거나 거부의 의사를 표시한 경우는 제외한다.
