Enforcement Decree of the Industrial Accident Compensation Insurance Act, Article 30 (Accidents During Events)
운동경기ㆍ야유회ㆍ등산대회 등 각종 행사(이하 "행사"라 한다)에 근로자가 참가하는 것이 사회통념상 노무관리 또는 사업운영상 필요하다고 인정되는 경우로서 다음 각 호의 어느 하나에 해당하는 경우에 근로자가 그 행사에 참가(행사 참가를 위한 준비ㆍ연습을 포함한다)하여 발생한 사고는 법 제37조제1항제1호라목에 따른 업무상 사고로 본다.
Where a worker's participation in various events, such as sports competitions, picnics, and hiking contests (hereinafter referred to as "events"), is considered necessary by social norms for labor management or business operations, and any of the following applies, an accident that occurs while the worker participates in the event (including preparation and practice for participating in it) shall be deemed an occupational accident caused by an incident under Article 37 (1) 1 (d) of the Act:
1. 사업주가 행사에 참가한 근로자에 대하여 행사에 참가한 시간을 근무한 시간으로 인정하는 경우
1. Where the business owner recognizes the time workers spent participating in the event as working time;
2. 사업주가 그 근로자에게 행사에 참가하도록 지시한 경우
2. Where the business owner instructed the worker to participate in the event;
3. 사전에 사업주의 승인을 받아 행사에 참가한 경우
3. Where the worker participated in the event with the business owner's prior approval;
4. 그 밖에 제1호부터 제3호까지의 규정에 준하는 경우로서 사업주가 그 근로자의 행사 참가를 통상적ㆍ관례적으로 인정한 경우
4. Any other case similar to subparagraphs 1 through 3 in which the business owner has ordinarily or customarily recognized the worker's participation in the event.
