아동복지법 제15조의4(아동보호 사각지대 발굴 및 실태조사)

① 보건복지부장관은 보호가 필요한 아동을 발견하고 양육환경을 개선할 수 있도록 지원하기 위하여 「사회보장기본법」 제37조에 따른 사회보장정보시스템(이하 "사회보장정보시스템"이라 한다)을 통하여 다음 각 호의 자료 또는 정보를 처리할 수 있으며, 해당 자료를 토대로 아동보호를 위한 실태조사 대상 아동을 선정할 수 있다. <개정 2024.1.23>

② 보건복지부장관은 아동보호의 사각지대 해소를 위하여 제1항에 따른 자료 또는 정보 및 실태조사 대상 아동의 명단을 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 제공할 수 있다.

③ 시ㆍ도지사 및 시장ㆍ군수ㆍ구청장은 보건복지부장관이 제2항에 따라 제공한 자료 또는 정보 및 실태조사 대상 아동의 명단을 토대로 아동의 주소지 등을 방문하여 양육환경 조사를 실시하여야 한다.

④ 보건복지부장관, 시ㆍ도지사 및 시장ㆍ군수ㆍ구청장은 제3항에 따른 조사 결과 필요하다고 인정하는 경우에는 복지서비스의 제공, 제15조에 따른 보호조치, 수사기관 또는 아동보호전문기관과의 연계 등 적절한 조치를 하여야 한다.

⑤ 보건복지부장관은 아동보호 사각지대 발굴 및 아동 보호 체계를 갖추기 위하여 필요한 정보시스템을 구축ㆍ운영할 수 있으며, 이 경우 사회보장정보시스템을 연계하여 이용할 수 있다.

⑥ 제3항에 따라 조사를 실시하는 사람은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.
