자동차손해배상 보장법 제6조(의무보험 미가입자에 대한 조치 등)

① 보험회사등은 자기와 제5조제1항부터 제3항까지의 규정에 따라 자동차보유자가 가입하여야 하는 보험 또는 공제(이하 "의무보험"이라 한다)의 계약을 체결하고 있는 자동차보유자에게 그 계약 종료일의 75일 전부터 30일 전까지의 기간 및 30일 전부터 10일 전까지의 기간에 각각 그 계약이 끝난다는 사실을 알려야 한다. 다만, 보험회사등은 보험기간이 1개월 이내인 계약인 경우와 자동차보유자가 자기와 다시 계약을 체결하거나 다른 보험회사등과 새로운 계약을 체결한 사실을 안 경우에는 통지를 생략할 수 있다. <개정 2009.2.6>

② 보험회사등은 의무보험에 가입하여야 할 자가 다음 각 호의 어느 하나에 해당하면 그 사실을 국토교통부령으로 정하는 기간 내에 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장(자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)에게 알려야 한다. <개정 2013.3.23, 2021.7.27>

③ 제2항에 따른 통지를 받은 시장ㆍ군수ㆍ구청장은 의무보험에 가입하지 아니한 자동차보유자에게 지체 없이 10일 이상 15일 이하의 기간을 정하여 의무보험에 가입하고 그 사실을 증명할 수 있는 서류를 제출할 것을 명하여야 한다.

④ 시장ㆍ군수ㆍ구청장은 의무보험에 가입되지 아니한 자동차의 등록번호판(이륜자동차 번호판 및 건설기계의 등록번호표를 포함한다. 이하 같다)을 영치할 수 있다.

⑤ 시장ㆍ군수ㆍ구청장은 제4항에 따라 의무보험에 가입되지 아니한 자동차의 등록번호판을 영치하기 위하여 필요하면 경찰서장에게 협조를 요청할 수 있다. 이 경우 협조를 요청받은 경찰서장은 특별한 사유가 없으면 이에 따라야 한다.

⑥ 시장ㆍ군수ㆍ구청장은 제4항에 따라 의무보험에 가입되지 아니한 자동차의 등록번호판을 영치하면 「자동차관리법」이나 「건설기계관리법」에 따라 그 자동차의 등록업무를 관할하는 시ㆍ도지사와 그 자동차보유자에게 그 사실을 통보하여야 한다. <개정 2012.2.22>

⑦ 제1항과 제2항에 따른 통지의 방법과 절차에 관하여 필요한 사항, 제4항에 따른 자동차 등록번호판의 영치 및 영치 해제의 방법ㆍ절차 등에 관하여 필요한 사항은 국토교통부령으로 정한다. <개정 2013.3.23>
