자본시장과 금융투자업에 관한 법률 제427조의2(조사권한의 남용 금지)

① 조사공무원 및 제426조에 따라 조사업무를 수행하는 금융감독원 소속 직원(이하 "조사원"이라 한다)은 이 법의 시행을 위하여 필요한 최소한의 범위 안에서 조사를 행하여야 하며, 다른 목적 등을 위하여 조사권을 남용하여서는 아니 된다.

② 금융위원회는 조사원의 조사권 남용을 방지하고 조사절차의 적법성을 보장하기 위한 구체적 기준을 정하여 고시할 수 있다.
