저작권법 시행령 제16조의3(상당한 조사의 기준)

1. 법 제35조의4에 따라 공표된 저작물을 이용하려는 문화시설이 그 문화시설에서 보관하고 있는 자료를 통해 저작재산권자나 그의 거소에 관한 정보를 확인할 것

2. 법 제55조제1항에 따른 저작권등록부를 통해 해당 저작물의 저작재산권자나 그의 거소에 관한 정보를 조회할 것

5. 「도서관법」 제3조제2호에 따른 도서관자료 및 같은 법 제20조제1항제3호에 따른 국가 서지에 관한 정보를 통해 저작재산권자나 그의 거소에 관한 정보를 조회할 것

8. 창작자에 관한 정보를 관리하고 있는 단체(「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관을 포함한다)로서 문화체육관광부장관이 정하여 고시하는 단체에 문화체육관광부령으로 정하는 바에 따라 저작재산권자나 그의 거소에 관한 정보를 조회할 것
