정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제18조(정신건강전문요원의 결격사유)
Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients, Article 18 (Grounds for Disqualification of Mental Health Professionals)
다음 각 호의 어느 하나에 해당하는 사람은 정신건강전문요원이 될 수 없다. <개정 2018.12.11, 2020.4.7, 2024.10.22>
None of the following persons may become a mental health professional:
1. 피성년후견인
1. A person under adult guardianship;
2. 이 법이나 다음 각 목의 어느 하나에 해당하는 법을 위반하여 금고 이상의 실형을 선고받고 그 집행이 끝나거나(집행이 끝난 것으로 보는 경우를 포함한다) 집행이 면제되지 아니한 사람
2. A person who has been sentenced to imprisonment without labor or a heavier punishment, without suspension, for violating this Act or any of the following Acts, and whose sentence has not been completely executed (including where it is deemed to have been completely executed) or whose execution has not been exempted:
가. 「농어촌 등 보건의료를 위한 특별조치법」
(a) The Act on Special Measures for Public Health and Medical Services in Agricultural and Fishing Villages, etc.;
나. 「마약류 관리에 관한 법률」
(b) The Act on the Control of Narcotics, etc.;
다. 「모자보건법」
(c) The Mother and Child Health Act;
라. 「보건범죄 단속에 관한 특별조치법」
(d) The Act on Special Measures for the Control of Public Health Crimes;
마. 「사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률」
(e) The Act on the Use and Provision of Social Security Benefits and Search for Eligible Beneficiaries;
바. 「사회복지사업법」
(f) The Social Welfare Services Act;
사. 「시체 해부 및 보존 등에 관한 법률」
(g) The Act on the Dissection and Preservation of Corpses;
아. 「약사법」
(h) The Pharmaceutical Affairs Act;
자. 「응급의료에 관한 법률」
(i) The Emergency Medical Service Act;
차. 「의료기사 등에 관한 법률」
(j) The Medical Service Technologists Act;
카. 「의료법」
(k) The Medical Service Act;
타. 「지역보건법」
(l) The Regional Public Health Act;
파. 「혈액관리법」
(m) The Blood Management Act;
하. 「후천성면역결핍증 예방법」
(n) The Acquired Immunodeficiency Syndrome Prevention Act;
거. 「형법」 중 제233조, 제234조(제233조의 죄에 의하여 작성된 허위진단서등을 행사한 사람만 해당한다. 이하 같다), 제235조(제233조 및 제234조의 미수범만 해당한다), 제269조, 제270조제2항ㆍ제3항, 제317조제1항 및 제347조(거짓으로 진료비를 청구하여 환자나 진료비를 지급하는 기관ㆍ단체를 속인 경우만 해당한다)
(o) Articles 233 and 234 (limited to persons who used a false medical certificate, etc. made by the crime under Article 233; the same applies hereinafter), Article 235 (limited to attempts of the crimes under Articles 233 and 234), Article 269, Article 270 (2) and (3), Article 317 (1), and Article 347 (limited to cases of deceiving a patient or an institution or organization that pays medical expenses by falsely claiming medical expenses) of the Criminal Act;
2의2. 이 법이나 제2호 각 목의 어느 하나에 해당하는 법을 위반하여 금고 이상의 형의 집행유예를 선고받고 그 유예기간 중에 있는 사람
2-2. A person who has been sentenced to imprisonment without labor or a heavier punishment with suspension of execution for violating this Act or any of the Acts in the items of subparagraph 2, and whose suspension period has not yet expired;
3. 「성폭력범죄의 처벌 등에 관한 특례법」 제2조에 따른 성폭력범죄 또는 「아동ㆍ청소년의 성보호에 관한 법률」 제2조제2호에 따른 아동ㆍ청소년대상 성범죄를 저질러 금고 이상의 실형 또는 치료감호를 선고받고 그 집행이 끝나거나(집행이 끝난 것으로 보는 경우를 포함한다) 집행이 면제되지 아니한 사람
3. A person who has been sentenced, without suspension, to imprisonment without labor or a heavier punishment, or to medical treatment and custody, for committing a sexual violence crime under Article 2 of the Act on Special Cases concerning the Punishment of Sexual Crimes or a sex offense against a child or youth under Article 2, subparagraph 2 of the Act on the Protection of Children and Youth against Sex Offenses, and whose sentence has not been completely executed (including where it is deemed to have been completely executed) or whose execution has not been exempted;
4. 제3호의 죄를 범하여 금고 이상의 형의 집행유예를 선고받고 그 유예기간 중에 있는 사람
4. A person who has been sentenced to imprisonment without labor or a heavier punishment with suspension of execution for committing a crime under subparagraph 3, and whose suspension period has not yet expired.
