Enforcement Decree of the Immigration Act, Article 82 (Search and Inspection of Vessels, etc.)
① 출입국관리공무원이 선박등에 승선하여 법 제69조 및 제70조에 따른 검색 및 심사를 할 때에는 다음 각 호의 사항을 확인하여야 한다.
(1) When an immigration officer boards a vessel, etc. and conducts a search and inspection under Articles 69 and 70 of the Act, the officer shall verify the following:
1. 여권 또는 선원신분증명서가 유효한지 여부
1. Whether passports or seafarer's identity documents are valid;
2. 승무원 또는 승객이 정당한 절차에 따라 승선하였는지 여부
2. Whether crew members or passengers boarded through proper procedures;
3. 승선 중인 승무원 또는 승객과 법 제75조제1항에 따라 제출된 승무원명부 및 승객명부의 명단이 일치하는지 여부
3. Whether the crew members or passengers on board match the names on the crew list and passenger list submitted under Article 75 (1) of the Act;
4. 승무원 또는 승객 중에 출입국이 금지된 사람이 있는지 여부
4. Whether any crew members or passengers are prohibited from entering or departing;
5. 입항선박의 경우 검색 전에 승무원 또는 승객이 하선한 사실이 있는지 여부
5. In the case of an arriving vessel, whether any crew members or passengers disembarked before the search;
6. 출항선박의 경우 검색 시까지 선박으로 돌아오지 아니한 승무원 또는 승객이 있는지 여부
6. In the case of a departing vessel, whether any crew members or passengers have not returned to the vessel by the time of the search;
7. 승무원 또는 승객 외에 승선허가를 받지 아니하고 선박등에 무단출입한 사람이 있는지 여부
7. Whether anyone other than crew members or passengers has entered the vessel, etc. without boarding permission;
8. 정당한 절차를 거치지 아니하고 출입국하려는 사람이 선박등에 숨어 있는지 여부
8. Whether anyone intending to enter or depart without going through proper procedures is hiding on the vessel, etc.
② 청장ㆍ사무소장 또는 출장소장은 제1항에 따른 출입국관리공무원의 승선검색으로 인하여 선박등의 출항이 지연될 우려가 있거나 그 밖에 필요하다고 인정할 때에는 선박등의 출항에 앞서 여권 또는 선원신분증명서 등 필요한 서류를 제출하게 하여 미리 승무원 및 승객의 자격을 심사하게 할 수 있다. <개정 2018.5.8>
(2) Where it is feared that the departure of a vessel, etc. will be delayed by an immigration officer's on-board search under paragraph (1), or where otherwise deemed necessary, a Commissioner, an Office Director, or a Branch Office Director may have the qualifications of crew members and passengers examined in advance by requiring the submission of necessary documents, such as passports or seafarer's identity documents, before the vessel, etc. departs.
