출입국관리법 시행령 제87조(보고의 의무)
Enforcement Decree of the Immigration Act, Article 87 (Duty to Report)
① 선박등의 장 또는 운수업자는 법 제69조에 따른 검색을 받을 때에 법 제75조제1항에 따른 출ㆍ입항보고서를 제출하여야 한다. 다만, 법 제69조제6항에 따라 서류심사를 받을 때에는 그 때 제출한다.
(1) The master of a vessel, etc. or a carrier shall submit a departure or arrival report under Article 75 (1) of the Act when undergoing a search under Article 69 of the Act: Provided, That when undergoing a document inspection under Article 69 (6) of the Act, the report shall be submitted at that time.
② 법 제75조제1항의 출ㆍ입항보고서 중 출입국항에 출ㆍ입항하는 선박등의 장 또는 선박등에 관한 사업을 하는 운수업자가 제출하여야 하는 승무원명부와 승객명부에는 승무원 및 승객 각자에 대하여 다음 각 호의 사항을 적어야 한다. <개정 2012.5.25>
(2) The crew list and passenger list that, as part of the departure or arrival report under Article 75 (1) of the Act, must be submitted by the master of a vessel, etc. departing from or arriving at a port of entry and departure or by a carrier operating a business relating to vessels, etc. shall state the following for each crew member and passenger:
1. 국적
1. Nationality;
2. 여권에 적힌 성명
2. Name as stated in the passport;
3. 생년월일
3. Date of birth;
4. 성별
4. Sex;
5. 여행문서의 종류 및 번호
5. Type and number of travel document;
6. 환승객인지 여부(승객만 해당한다)
6. Whether the person is a transit passenger (applicable only to passengers);
7. 승객의 얼굴에 관한 정보(법 제14조의2에 따라 관광상륙허가를 신청하려는 경우만 해당한다)
7. Facial information of passengers (applicable only where tourist shore leave permission is to be applied for under Article 14-2 of the Act).
③ 법 제75조제1항의 출ㆍ입항보고서 중 출입국항에 출ㆍ입항하는 선박등의 장 또는 선박등에 관한 사업을 하는 운수업자가 제출하여야 하는 선박등에 관한 정보에는 다음 각 호의 사항을 적어야 한다. <개정 2012.5.25>
(3) The information on the vessel, etc. that, as part of the departure or arrival report under Article 75 (1) of the Act, must be submitted by the master of a vessel, etc. departing from or arriving at a port of entry and departure or by a carrier operating a business relating to vessels, etc. shall state the following:
1. 선박등의 종류
1. Type of vessel, etc.;
2. 등록기호 및 명칭
2. Registration code and name;
3. 국적
3. Nationality;
4. 출항지 및 출항시간
4. Place and time of departure;
5. 경유지 및 경유시간
5. Places and times of transit;
6. 입항지 및 입항시간
6. Place and time of arrival;
7. 승무원ㆍ승객ㆍ환승객의 수
7. Number of crew members, passengers, and transit passengers.
④ 청장ㆍ사무소장 또는 출장소장은 법 제75조제1항 및 제2항에 따라 표준 전자문서로 제출된 출ㆍ입항보고서에 승무원명부 또는 승객명부 중 빠진 사람이 있는 등 보완할 사항이 있는 경우에는 지체 없이 선박등의 장 또는 운수업자에게 보완하여 제출하도록 할 수 있다. <개정 2012.5.25, 2018.5.8>
(4) Where a departure or arrival report submitted as a standard electronic document under Article 75 (1) and (2) of the Act needs to be supplemented, such as where a person is missing from the crew list or passenger list, a Commissioner, an Office Director, or a Branch Office Director may require the master of the vessel, etc. or the carrier to supplement and resubmit it without delay.
⑤ 법 제75조제1항에 따른 출ㆍ입항보고서의 제출시기는 다음 각 호의 구분에 따른다. <개정 2012.5.25, 2012.10.15>
(5) The time for submitting a departure or arrival report under Article 75 (1) of the Act shall be as follows:
1. 입항의 경우: 국내 입항 2시간 이전까지(법 제14조의2에 따라 관광상륙허가를 신청하려는 경우는 24시간 이전까지를 말한다). 다만, 출발국 출항 후 국내 입항까지의 시간이 2시간(관광상륙허가를 신청하려는 경우는 24시간을 말한다) 미만인 경우에는 출발국에서 출항 후 20분 이내까지 할 수 있다.
1. For arrival: no later than two hours before arrival in the Republic of Korea (or 24 hours where tourist shore leave permission is to be applied for under Article 14-2 of the Act): Provided, That where the time from departure from the country of departure to arrival in the Republic of Korea is less than two hours (or 24 hours where tourist shore leave permission is to be applied for), the report may be submitted within 20 minutes after departure from the country of departure;
2. 출항의 경우: 출항 준비가 끝나는 즉시
2. For departure: immediately upon completion of preparations for departure.
