출입국관리법 시행령 제88조의5(관리비용의 부담 및 납부 절차)

① 국가는 법 제76조의3제1항에 따라 송환대상외국인이 출국하기 전까지 다음 각 호의 물품을 제공하는 데 드는 비용(이하 "관리비용"이라 한다)을 부담한다. 다만, 법 제76조의2제1항 단서에 따라 송환대상외국인의 신청으로 송환대기장소를 변경한 경우에는 부담하지 않는다.

② 제1항 각 호의 물품을 제공하는 방법 및 세부기준은 법무부장관이 정하여 고시한다.

③ 청장ㆍ사무소장 또는 출장소장은 법 제76조의3제2항에 따라 관리비용을 선박등의 장 또는 운수업자가 부담하게 하려는 경우에는 송환대상외국인이 출국대기실에서 퇴실하였을 때에 다음 각 호의 사항이 기재된 납부고지서를 발급하여야 한다. 다만, 관리 기간이 1개월을 초과하는 경우에는 1개월 단위로 발급할 수 있다.

④ 제3항에 따른 관리비용의 범위 및 세부기준에 관하여는 제1항 각 호 외의 부분 본문, 같은 항 각 호 및 제2항을 준용한다.

⑤ 법무부장관은 제3항에 따른 납부고지서 발급 등을 위하여 필요한 정보통신망을 구축ㆍ운영할 수 있다.
