행정심판법 시행령 제43조(권한의 위임)
Enforcement Decree of the Administrative Appeals Act, Article 43 (Delegation of Authority)
위원회는 법 제61조에 따라 다음 각 호의 권한을 위원장에게 위임한다. <개정 2018.4.17, 2018.10.30, 2026.6.16>
Under Article 61 of the Act, a commission delegates the following authority to the chairperson:
1. 법 제15조제2항에 따른 선정대표자 선정권고
1. Recommending the appointment of appointed representatives under Article 15 (2) of the Act;
2. 법 제16조제5항에 따른 지위 승계 허가
2. Permitting succession to status under Article 16 (5) of the Act;
3. 법 제17조제2항 및 제5항에 따른 피청구인의 경정 결정
3. Deciding on the correction of the respondent under Article 17 (2) and (5) of the Act;
4. 법 제18조제1항제5호에 따른 대리인 선임허가
4. Permitting the appointment of agents under Article 18 (1) 5 of the Act;
4의2. 법 제18조의2제2항에 따른 국선대리인의 선정 여부 결정 및 통지
4-2. Deciding whether to appoint a state-appointed agent under Article 18-2 (2) of the Act, and giving notice of the decision;
5. 법 제20조제5항에 따른 심판참가 허가 및 법 제21조제1항에 따른 심판참가 요구
5. Permitting intervention in appeals under Article 20 (5) of the Act and requesting intervention in appeals under Article 21 (1) of the Act;
6. 법 제29조제6항에 따른 청구의 취지 또는 이유의 변경허가 여부 결정
6. Deciding whether to permit amendment of the purport of or reasons for a claim under Article 29 (6) of the Act;
7. 법 제32조제1항에 따른 보정 요구 및 직권보정
7. Requiring correction and making corrections on its own authority under Article 32 (1) of the Act;
8. 법 제40조제2항에 따른 구술심리 신청의 허가 여부 결정
8. Deciding whether to grant applications for oral hearings under Article 40 (2) of the Act;
8의2. 제16조의4에 따른 국선대리인의 선정 취소, 사임 허가, 재선정 및 이에 해당되는 사실의 통지
8-2. Revoking the appointment of state-appointed agents, permitting their resignation, appointing new ones, and giving notice of these facts under Article 16-4;
9. 제30조의2제1항 전단에 따른 조정개시 결정
9. Deciding to commence mediation under the former part of Article 30-2 (1).
