가족관계의 등록 등에 관한 법률 제44조의4(출생신고의 확인ㆍ최고 및 직권 출생 기록)

① 제44조의3제3항에 따른 통보를 받은 시ㆍ읍ㆍ면의 장은 제44조제1항에 따른 신고기간 내에 출생자에 대한 출생신고가 되었는지를 확인하여야 한다.

② 시ㆍ읍ㆍ면의 장은 제44조제1항에 따른 신고기간이 지나도록 제44조의3제3항에 따라 통보받은 출생자에 대한 출생신고가 되지 아니한 경우에는 즉시 제46조제1항 및 제2항에 따른 신고의무자에게 7일 이내에 출생신고를 할 것을 최고하여야 한다.

③ 시ㆍ읍ㆍ면의 장은 다음 각 호의 어느 하나에 해당하는 경우 제44조의3제3항에 따라 통보받은 자료를 첨부하여 감독법원의 허가를 받아 해당 출생자에 대하여 직권으로 등록부에 출생을 기록하여야 한다.

④ 제1항부터 제3항까지에서 규정한 사항 외에 출생신고 확인, 출생신고 최고, 출생자의 성명ㆍ본 및 등록기준지의 결정 방법 등에 관하여 필요한 사항은 대법원규칙으로 정한다.
