공직선거법 제30조(지방자치단체의 폐치ㆍ분합시의 선거 등)

1. 시ㆍ자치구 또는 광역시가 새로 설치된 때에는 당해 지방자치단체의 장은 새로 선거를 실시한다.

2. 하나의 지방자치단체가 분할되어 2 이상의 같은 종류의 지방자치단체로 된 때에는 종전의 지방자치단체의 장은 새로 설치된 지방자치단체중 종전의 지방자치단체의 사무소가 위치한 지역을 관할하는 지방자치단체의 장으로 되며, 그 다른 지방자치단체의 장은 새로 선거를 실시한다. 이 경우 종전의 지방자치단체의 사무소가 다른 지방자치단체의 관할구역안에 있는 때에는 지방자치단체의 분할에 관한 법률제정시 새로 선거를 실시할 지방자치단체를 정하여야 한다.

3. 2 이상의 같은 종류의 지방자치단체가 합하여 새로운 지방자치단체가 설치된 때에는 종전의 지방자치단체의 장은 그 직을 상실하고, 새로운 지방자치단체의 장에 대해서는 새로 선거를 실시한다.

4. 지방자치단체가 다른 지방자치단체에 편입됨으로 인하여 폐지된 때에는 그 폐지된 지방자치단체의 장은 그 직을 상실한다.
