교통사고처리 특례법 시행령 제3조(우선지급할 치료비외의 손해배상금의 범위)
Enforcement Decree of the Act on Special Cases concerning the Settlement of Traffic Accidents, Article 3 (Scope of Damages Other Than Medical Expenses to Be Paid First)
①법 제4조제2항의 규정에 의하여 우선지급하여야 할 치료비외의 손해배상금의 범위는 다음 각호와 같다.
(1) The scope of damages other than medical expenses to be paid first under Article 4 (2) of the Act shall be as follows:
1. 부상의 경우보험약관 또는 공제약관에서 정한 지급기준에 의하여 산출한 위자료의 전액과 휴업손해액의 100분의 50에 해당하는 금액
1. In the case of bodily injury: the full amount of consolation money calculated according to the payment criteria set out in the insurance terms or mutual aid terms, and an amount equal to 50/100 of the loss from inability to work;
2. 후유장애의 경우보험약관 또는 공제약관에서 정한 지급기준에 의하여 산출한 위자료 전액과 상실수익액의 100분의 50에 해당하는 금액
2. In the case of after-effect disability: the full amount of consolation money calculated according to the payment criteria set out in the insurance terms or mutual aid terms, and an amount equal to 50/100 of the lost earnings;
3. 대물손해의 경우보험약관 또는 공제약관에서 정한 지급기준에 의하여 산출한 대물배상액의 100분의 50에 해당하는 금액
3. In the case of property damage: an amount equal to 50/100 of the compensation for property damage calculated according to the payment criteria set out in the insurance terms or mutual aid terms.
②제1항제1호 및 제2호의 규정에 의한 위자료가 중복되는 경우에는 보험약관 또는 공제약관이 정하는 바에 의하여 지급한다.
(2) Where consolation money under paragraph (1) 1 and 2 overlaps, it shall be paid as provided in the insurance terms or mutual aid terms.
