국가인권위원회법 제48조(긴급구제 조치의 권고)

① 위원회는 진정을 접수한 후 조사대상 인권침해나 차별행위가 계속되고 있다는 상당한 개연성이 있고, 이를 방치할 경우 회복하기 어려운 피해가 발생할 우려가 있다고 인정하면 그 진정에 대한 결정 이전에 진정인이나 피해자의 신청에 의하여 또는 직권으로 피진정인, 그 소속기관등의 장에게 다음 각 호의 어느 하나의 조치를 하도록 권고할 수 있다.

② 위원회는 필요하다고 인정하면 당사자 또는 관계인 등의 생명과 신체의 안전, 명예의 보호, 증거의 확보 또는 증거 인멸의 방지를 위하여 필요한 조치를 하거나 관계인 및 그 소속기관등의 장에게 그 조치를 권고할 수 있다.
