국민건강보험법 시행령 제22조(약제ㆍ치료재료의 요양급여비용)

① 법 제46조에 따라 법 제41조제1항제2호의 약제ㆍ치료재료(제21조제2항 및 제3항에 따른 상대가치점수가 적용되는 약제ㆍ치료재료는 제외한다. 이하 이 조에서 같다)에 대한 요양급여비용은 다음 각 호의 구분에 따라 결정한다. 이 경우 구입금액(요양기관이 해당 약제 및 치료재료를 구입한 금액을 말한다. 이하 이 조에서 같다)이 상한금액(보건복지부장관이 심의위원회의 심의를 거쳐 해당 약제 및 치료재료별 요양급여비용의 상한으로 고시하는 금액을 말한다. 이하 같다)보다 많을 때에는 구입금액은 상한금액과 같은 금액으로 한다. <개정 2013.1.28, 2013.3.23, 2014.8.29>

② 제1항에 따른 약제 및 치료재료에 대한 요양급여비용의 결정 기준ㆍ절차, 그 밖에 필요한 사항은 보건복지부장관이 정하여 고시한다.
