국토의 계획 및 이용에 관한 법률 시행령 제26조(시행중인 공사에 대한 특례)

①시가화조정구역 또는 수산자원보호구역의 지정에 관한 도시ㆍ군관리계획의 결정 당시 이미 사업 또는 공사에 착수한 자는 당해 사업 또는 공사를 계속하고자 하는 때에는 법 제31조제2항 단서의 규정에 의하여 시가화조정구역 또는 수산자원보호구역의 지정에 관한 도시ㆍ군관리계획결정의 고시일부터 3월 이내에 그 사업 또는 공사의 내용을 관할 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수에게 신고하여야 한다. <개정 2012.4.10>

②제1항의 규정에 의하여 신고한 행위가 건축물의 건축을 목적으로 하는 토지의 형질변경인 경우 당해 건축물을 건축하고자 하는 자는 토지의 형질변경에 관한 공사를 완료한 후 3월 이내에 건축허가를 신청하는 때에는 당해 건축물을 건축할 수 있다.

③건축물의 건축을 목적으로 하는 토지의 형질변경에 관한 공사를 완료한 후 1년 이내에 제1항의 규정에 의한 도시ㆍ군관리계획결정의 고시가 있는 경우 당해 건축물을 건축하고자 하는 자는 당해 도시ㆍ군관리계획결정의 고시일부터 6월 이내에 건축허가를 신청하는 때에는 당해 건축물을 건축할 수 있다. <개정 2012.4.10>
