Enforcement Decree of the Basic Pension Act, Article 16 (Requests for and Provision of Financial Information, etc.)

① 보건복지부장관이 법 제12조제1항 및 제2항에 따라 금융기관등(「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등과 「신용정보의 이용 및 보호에 관한 법률」 제25조제2항제1호에 따른 종합신용정보집중기관을 말한다. 이하 같다)의 장에게 기초연금 수급희망자, 기초연금 수급권자와 그 각각의 배우자의 금융정보등을 제공하도록 요청할 때에는 요청내용에 다음 각 호의 사항이 포함되어야 한다. <개정 2020.8.4>

③ 보건복지부장관은 금융기관등이 가입한 협회, 연합회 또는 중앙회(이하 "협회등"이라 한다)가 금융정보등에 관한 정보통신망을 관리하는 경우 그 협회등의 정보통신망을 이용하여 해당 금융기관등의 장에게 제1항에 따른 금융정보등을 제공하도록 요청할 수 있다.

④ 보건복지부장관이 법 제12조제2항에 따라 기초연금 수급권자 및 그 배우자의 금융정보등을 요청할 때에는 제15조제1항에 따른 조사의 목적에 필요한 최소한의 범위에서 다음 각 호의 어느 하나에 해당하는 경우에만 요청할 수 있다.
