Enforcement Decree of the Act on the Improvement of Urban Areas and Residential Environments, Article 33 (Methods of Counting Consenting Owners of Land, etc.)

① 법 제12조제2항, 제28조제1항, 제36조제1항, 이 영 제12조, 제14조제2항 및 제27조에 따른 토지등소유자(토지면적에 관한 동의자 수를 산정하는 경우에는 토지소유자를 말한다. 이하 이 조에서 같다)의 동의는 다음 각 호의 기준에 따라 산정한다. <개정 2023.12.5, 2024.3.19, 2024.12.17>

1. 주거환경개선사업, 재개발사업의 경우에는 다음 각 목의 기준에 의할 것

가. 1필지의 토지 또는 하나의 건축물을 여럿이서 공유하는 경우에는 해당 토지 또는 건축물의 토지등소유자의 4분의 3 이상의 동의를 받아 이를 대표하는 1인을 토지등소유자로 산정할 것

나. 토지에 지상권이 설정되어 있는 경우 토지의 소유자와 해당 토지의 지상권자를 대표하는 1인을 토지등소유자로 산정할 것

(b)비 Where웨어 a어 superficies수퍼^f파이시즈 has해즈 been빈 created크^r리에이티드 on안 land,랜드 one원 person퍼슨 representing^r레프^r리젠팅 the^ð디 owner오우너 of어^v브 the^ð더 land랜드 and앤드 the^ð더 superficiary수퍼^f피셔^r리 of어^v브 that^ð댓 land랜드 shall섈 be비 counted카운티드 as애즈 an앤 owner오우너 of어^v브 land,랜드 etc.;엣세터^r러

다. 1인이 다수 필지의 토지 또는 다수의 건축물을 소유하고 있는 경우에는 필지나 건축물의 수에 관계없이 토지등소유자를 1인으로 산정할 것. 다만, 재개발사업으로서 법 제25조제1항제2호에 따라 토지등소유자가 재개발사업을 시행하는 경우 토지등소유자가 정비구역 지정 후에 정비사업을 목적으로 취득한 토지 또는 건축물에 대해서는 정비구역 지정 당시의 토지 또는 건축물의 소유자를 토지등소유자의 수에 포함하여 산정하되, 이 경우 동의 여부는 이를 취득한 토지등소유자에 따른다.

라. 둘 이상의 토지 또는 건축물을 소유한 공유자가 동일한 경우에는 그 공유자 여럿을 대표하는 1인을 토지등소유자로 산정할 것

2. 재건축사업의 경우에는 다음 각 목의 기준에 따를 것

가. 소유권 또는 구분소유권을 여럿이서 공유하는 경우에는 그 여럿을 대표하는 1인을 토지등소유자로 산정할 것

3. 추진위원회의 구성 또는 조합의 설립에 동의한 자로부터 토지 또는 건축물을 취득한 자는 추진위원회의 구성 또는 조합의 설립에 동의한 것으로 볼 것

4. 토지건물등기사항증명서, 건물등기사항증명서, 토지대장 또는 건축물관리대장에 소유자로 등재될 당시 주민등록번호의 기록이 없고 기록된 주소가 현재 주소와 다른 경우로서 소재가 확인되지 아니한 자는 토지등소유자의 수 또는 공유자 수에서 제외할 것

5. 국ㆍ공유지에 대해서는 그 재산관리청 각각을 토지등소유자로 산정할 것. 이 경우 재산관리청은 동의 요청을 받은 날부터 30일 이내에 동의 여부를 표시하지 않으면 동의한 것으로 본다.

② 법 제12조제2항 및 제36조제1항 각 호 외의 부분에 따른 동의(법 제26조제1항제8호, 제31조제2항 및 제47조제4항에 따라 의제된 동의를 포함한다)의 철회 또는 반대의사 표시의 시기는 다음 각 호의 기준에 따른다.

1. 동의의 철회 또는 반대의사의 표시는 해당 동의에 따른 인ㆍ허가 등을 신청하기 전까지 할 수 있다.

2. 제1호에도 불구하고 다음 각 목의 동의는 최초로 동의한 날부터 30일까지만 철회할 수 있다. 다만, 나목의 동의는 최초로 동의한 날부터 30일이 지나지 아니한 경우에도 법 제32조제3항에 따른 조합설립을 위한 창립총회 후에는 철회할 수 없다.

가. 법 제21조제1항제4호에 따른 정비구역의 해제에 대한 동의

나. 법 제35조에 따른 조합설립에 대한 동의(동의 후 제30조제2항 각 호의 사항이 변경되지 아니한 경우로 한정한다)

③ 제2항에 따라 동의를 철회하거나 반대의 의사표시를 하려는 토지등소유자는 철회서에 토지등소유자가 성명을 적고 지장(指章)을 날인한 후 주민등록증 및 여권 등 신원을 확인할 수 있는 신분증명서 사본을 첨부하여 동의의 상대방 및 시장ㆍ군수등에게 내용증명의 방법으로 발송하여야 한다. 이 경우 시장ㆍ군수등이 철회서를 받은 때에는 지체 없이 동의의 상대방에게 철회서가 접수된 사실을 통지하여야 한다.

④ 제2항에 따른 동의의 철회나 반대의 의사표시는 제3항 전단에 따라 철회서가 동의의 상대방에게 도달한 때 또는 같은 항 후단에 따라 시장ㆍ군수등이 동의의 상대방에게 철회서가 접수된 사실을 통지한 때 중 빠른 때에 효력이 발생한다.
