동물보호법 제77조(직권말소)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 영업자가 제76조제1항에 따른 폐업신고를 하지 아니한 경우에는 농림축산식품부령으로 정하는 바에 따라 폐업 사실을 확인한 후 허가 또는 등록사항을 직권으로 말소할 수 있다.

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 영업자가 영업을 폐업하였는지를 확인하기 위하여 필요한 경우 관할 세무서장에게 영업자의 폐업 여부에 대한 정보 제공을 요청할 수 있다. 이 경우 요청을 받은 관할 세무서장은 정당한 사유 없이 이를 거부하여서는 아니 된다.
