산업재해보상보험법 시행령 제62조(유족보상연금의 지급정지 등)

① 법 제64조제2항에 따라 유족보상연금을 받을 권리가 이전된 경우에 유족보상연금을 새로 지급받으려는 사람은 공단에 유족보상연금 수급권자 변경신청을 하여야 한다.

② 법 제64조제3항에 따라 유족보상연금 수급권자가 3개월 이상 행방불명이면 같은 순위자(같은 순위자가 없는 경우에는 다음 순위자)의 신청에 따라 행방불명된 달의 다음 달 분부터 그 행방불명 기간 동안 그 행방불명된 사람에 대한 유족보상연금의 지급을 정지하고, 법 제62조제2항 및 법 별표 3에 따라 산정한 금액을 유족보상연금으로 지급한다. 이 경우 행방불명된 종전의 유족보상연금 수급권자는 법 제62조제2항 및 법 별표 3에 따른 가산금액이 적용되는 유족보상연금 수급자격자로 보지 않는다.

③ 제2항 전단에 따라 유족보상연금의 지급이 정지된 사람은 언제든지 그 지급정지의 해제를 신청할 수 있다.
