자본시장과 금융투자업에 관한 법률 제191조(반대수익자의 수익증권매수청구권)

① 투자신탁의 수익자는 다음 각 호의 어느 하나에 해당하는 경우 집합투자업자에게 수익증권의 수를 기재한 서면으로 자기가 소유하고 있는 수익증권의 매수를 청구할 수 있다. <개정 2013.5.28>

② 투자신탁을 설정한 집합투자업자는 제1항에 따른 청구가 있는 경우 해당 수익자에게 수익증권의 매수에 따른 수수료, 그 밖의 비용을 부담시켜서는 아니 된다.

③ 투자신탁을 설정한 집합투자업자는 제1항에 따른 청구가 있는 경우에는 매수청구기간이 만료된 날부터 15일 이내에 그 투자신탁재산으로 대통령령으로 정하는 방법에 따라 그 수익증권을 매수하여야 한다. 다만, 매수자금이 부족하여 매수에 응할 수 없는 경우에는 금융위원회의 승인을 받아 수익증권의 매수를 연기할 수 있다. <개정 2008.2.29>

④ 투자신탁을 설정한 집합투자업자는 제3항 본문에 따라 수익증권을 매수한 경우에는 지체 없이 그 수익증권을 소각(消却)하여야 한다.
