자본시장과 금융투자업에 관한 법률 제435조(위법행위의 신고 및 신고자 보호)

① 누구든지 제4편의 불공정거래행위, 그 밖에 이 법의 위반행위를 알게 되었거나 이를 강요 또는 제의받은 경우에는 금융위원회(제172조부터 제174조까지, 제176조, 제178조, 제178조의2, 제180조 및 제180조의2부터 제180조의6까지의 규정을 위반한 사항인 경우에는 증권선물위원회를 말한다. 이하 이 조에서 같다)에 신고 또는 제보할 수 있다. <개정 2008.2.29, 2014.12.30, 2016.3.29, 2021.1.5, 2024.10.22>

② 금융위원회는 제1항에 따른 신고 또는 제보를 받은 경우에는 이를 신속하게 처리하고, 그 처리결과를 신고자 또는 제보자(이하 이 조에서 "신고자등"이라 한다)에게 통지하여야 한다. <개정 2008.2.29, 2009.2.3>

⑤ 신고자등이 소속된 기관ㆍ단체 또는 회사는 그 신고자등에 대하여 그 신고 또는 제보와 관련하여 직접 또는 간접적인 방법으로 불리한 대우를 하여서는 아니 된다.

⑥ 신고자등이 신고의 내용이 거짓이라는 사실을 알았거나 알 수 있었음에도 불구하고 신고한 경우에는 이 법의 보호를 받지 못한다.

⑧ 제1항부터 제7항까지에 규정한 사항 외에 신고의 방법 및 처리, 신고자등에 대한 통지방법, 신고자등의 보호와 포상금 지급 등에 관한 사항은 대통령령으로 정한다. <개정 2009.2.3>
