국민건강보험법 시행령 제39조(보수월액보험료의 정산 및 분할납부)

① 공단은 원래 산정ㆍ징수한 보수월액보험료의 금액이 제34조부터 제38조까지의 규정에 따라 다시 산정한 보수월액보험료의 금액을 초과하는 경우에는 그 초과액을 사용자에게 반환하여야 하며, 부족한 경우에는 그 부족액을 사용자로부터 추가로 징수하여야 한다.

② 사용자는 직장가입자의 사용ㆍ임용ㆍ채용 관계가 끝난 경우에는 해당 직장가입자가 납부한 보수월액보험료를 다시 산정하여 근로자와 정산한 후 공단과 정산 절차를 거쳐야 한다. 다만, 법 제70조제3항 후단에 따라 보건복지부장관이 고시하는 금액이 적용되는 직장가입자에 대해서는 그 고시하는 금액이 적용되는 기간에 부과한 보수월액보험료의 정산을 생략할 수 있다.

③ 사용자는 제1항에 따라 반환받은 금액 또는 추가 납부한 금액 중 직장가입자가 반환받을 금액 및 부담하여야 할 금액에 대해서는 해당 직장가입자와 정산하여야 한다.

④ 공단은 제1항에 따라 추가로 징수해야 할 금액(이하 "추가징수금액"이라 한다) 중 직장가입자가 부담하는 금액이 제32조제2호가목에 따른 직장가입자의 보수월액보험료 하한액 이상인 경우에는 사용자의 신청에 따라 12회 이내의 범위에서 분할하여 납부하게 할 수 있다. <개정 2024.5.7, 2026.9.15>

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 보수월액보험료의 정산 및 분할납부에 필요한 세부 사항은 공단의 정관으로 정한다. <신설 2018.3.20>
