근로기준법 시행령 제59조의2(민감정보 및 고유식별정보의 처리)
Enforcement Decree of the Labor Standards Act, Article 59-2 (Processing of Sensitive Information and Personally Identifiable Information)
고용노동부장관(법 제43조의5에 따라 고용노동부장관의 업무를 위탁받은 자 및 이 영 제59조에 따라 고용노동부장관의 권한을 위임받은 자를 포함한다) 또는 노동위원회는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보(제7호의 사무만 해당한다)와 같은 법 시행령 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.6.21, 2025.4.8>
Where inevitable for performing the following affairs, the Minister of Employment and Labor (including a person entrusted with the Minister's work under Article 43-5 of the Act and a person delegated the Minister's authority under Article 59 of this Decree) or a labor relations commission may process information on health under Article 23 of the Personal Information Protection Act (only for the affairs in subparagraph 7) and data containing resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the same Act:
1. 법 제19조제2항에 따른 손해배상 청구에 관한 사무
1. Affairs concerning claims for damages under Article 19 (2) of the Act;
2. 법 제28조제1항에 따른 부당해고등의 구제에 관한 사무
2. Affairs concerning remedies for unfair dismissal, etc. under Article 28 (1) of the Act;
3. 법 제30조제3항에 따른 금품지급명령에 관한 사무
3. Affairs concerning orders to pay money and valuables under Article 30 (3) of the Act;
4. 법 제33조에 따른 부당해고 구제명령의 이행 확인 및 이행강제금 부과 등에 관한 사무
4. Affairs concerning confirmation of compliance with remedy orders for unfair dismissal and the imposition of charges for compelling compliance under Article 33 of the Act;
4의2. 법 제43조의2에 따른 체불사업주의 명단 공개 및 법 제43조의3에 따른 임금등 체불자료의 제공에 관한 사무
4-2. Affairs concerning the public disclosure of names of employers in arrears under Article 43-2 of the Act and the provision of data on unpaid wages, etc. under Article 43-3 of the Act;
4의3. 법 제43조의4에 따른 상습체불사업주에 대한 보조ㆍ지원 제한 등에 관한 사무
4-3. Affairs concerning restrictions on subsidies and support for habitual employers in arrears under Article 43-4 of the Act;
4의4. 법 제43조의6제1항 및 제2항에 따른 체불사업주 명단 공개 등을 위한 자료제공 요청 등에 관한 사무
4-4. Affairs concerning requests for the provision of data for the public disclosure of names of employers in arrears under Article 43-6 (1) and (2) of the Act;
4의5. 법 제43조의7에 따른 출국금지 요청 및 해제 요청에 관한 사무
4-5. Affairs concerning requests for prohibition of departure and for lifting it under Article 43-7 of the Act;
5. 법 제64조에 따른 취직인허증에 관한 사무
5. Affairs concerning employment permits under Article 64 of the Act;
6. 법 제81조에 따른 중대과실 인정에 관한 사무
6. Affairs concerning recognition of gross negligence under Article 81 of the Act;
7. 법 제88조제1항 및 제89조제1항에 따른 심사와 중재에 관한 사무
7. Affairs concerning review and arbitration under Articles 88 (1) and 89 (1) of the Act;
7의2. 법 제102조의2에 따른 자료 제공의 요청 등에 관한 사무
7-2. Affairs concerning requests for the provision of data under Article 102-2 of the Act;
8. 법 제104조에 따른 법 위반 사실의 통보에 관한 사무
8. Affairs concerning notification of violations of the Act under Article 104 of the Act;
9. 법 제112조에 따른 확정된 구제명령 등을 이행하지 아니한 자에 대한 고발에 관한 사무
9. Affairs concerning criminal complaints against persons who fail to comply with finalized remedy orders and similar orders under Article 112 of the Act.
