근로자퇴직급여 보장법 시행령 제43조(고유식별정보의 처리)
Enforcement Decree of the Employee Retirement Benefit Security Act, Article 43 (Processing of Personally Identifiable Information)
고용노동부장관(제41조에 따라 고용노동부장관의 권한을 위탁ㆍ위임받은 자를 포함한다), 사용자, 퇴직연금사업자, 근로복지공단, 법 제23조의6제3항에 따라 근로복지공단의 중소기업퇴직연금기금제도의 업무를 처리하는 자, 법 제28조제2항에 따라 퇴직연금사업자로부터 운용관리업무를 위탁받은 자, 법 제31조제2항 후단에 따라 퇴직연금제도 모집인 등록업무를 위탁받은 기관, 법 제32조제2항 후단에 따라 교육의 실시를 위탁받은 기관은 다음 각 호의 업무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호 또는 같은 조 제4호에 따른 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2020.11.3, 2022.4.13>
Where unavoidable to perform the following duties, the Minister of Employment and Labor (including persons entrusted or delegated with the authority of the Minister of Employment and Labor under Article 41), employers, retirement pension service providers, the Service, persons who handle duties of the Service's small and medium enterprise retirement pension fund plan under Article 23-6 (3) of the Act, persons entrusted with operational management services by retirement pension service providers under Article 28 (2) of the Act, institutions entrusted with the registration work for retirement pension plan solicitors under the latter part of Article 31 (2) of the Act, and institutions entrusted with providing education under the latter part of Article 32 (2) of the Act may process data that include resident registration numbers under subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act or alien registration numbers under subparagraph 4 of the same Article:
1. 법 제18조에 따른 운용현황의 통지에 관한 업무(법 제23조의11에서 준용하는 경우를 포함한다)
1. Duties concerning notice of investment status under Article 18 of the Act (including where it applies mutatis mutandis under Article 23-11 of the Act);
2. 법 제23조의6제1항에 따른 중소기업퇴직연금기금제도의 설정을 위한 계약의 체결에 관한 업무
2. Duties concerning the conclusion of contracts to establish the small and medium enterprise retirement pension fund plan under Article 23-6 (1) of the Act;
3. 법 제23조의8에 따른 기금제도가입자부담금계정의 설정에 관한 업무
3. Duties concerning the opening of fund plan member contribution accounts under Article 23-8 of the Act;
4. 법 제23조의14에 따른 국가의 지원 및 지원금 환수에 관한 업무
4. Duties concerning State support and the recovery of support payments under Article 23-14 of the Act;
5. 법 제23조의16에 따른 근로복지공단에 대한 지도ㆍ감독 등에 관한 업무
5. Duties concerning guidance and supervision, etc. of the Service under Article 23-16 of the Act;
6. 법 제26조에 따른 퇴직연금사업자의 등록에 관한 업무

12. 법 제32조제2항 후단에 따라 사용자로부터 위탁받은 교육에 필요한 업무
12. Duties necessary for education entrusted by employers under the latter part of Article 32 (2) of the Act;
13. 법 제33조제6항에 따른 퇴직연금제도의 취급실적 제출에 관한 업무
