기초연금법 시행령 제9조(기초연금의 금액을 기준연금액으로 하는 사람)
Enforcement Decree of the Basic Pension Act, Article 9 (Persons Whose Basic Pension Amount Is the Standard Pension Amount)
① 법 제5조제7항제2호다목에서 "대통령령으로 정하는 사람"이란 「국민기초생활 보장법」 제2조제2호에 따른 수급자를 말한다. <개정 2018.8.28>
(1) The person prescribed by Presidential Decree under Article 5 (7) 2 (c) of the Act means a recipient under Article 2, subparagraph 2 of the National Basic Living Security Act.
② 법 제5조제7항제2호라목에서 "대통령령으로 정하는 사람"이란 다음 각 호의 어느 하나에 해당하는 사람을 말한다. <개정 2018.8.28>
(2) "Other persons prescribed by Presidential Decree" in Article 5 (7) 2 (d) of the Act means persons who fall under any of the following:
1. 「국민연금법」 제13조제1항에 따라 임의계속가입 중인 사람
1. A person who is continuing voluntary coverage under Article 13 (1) of the National Pension Act;
2. 「국민연금법」 제64조제1항에 따른 분할연금 수급권을 취득한 후 해당 급여를 청구하지 아니한 사람
2. A person who has acquired the right to a split pension under Article 64 (1) of the National Pension Act but has not claimed the benefit;
3. 「국민연금과 직역연금의 연계에 관한 법률」 제18조제2항제1호나목에 따라 유족연금 수급권을 선택한 연계노령연금 수급권자
3. A person entitled to a linked old-age pension who has chosen the right to a survivors' pension under Article 18 (2) 1 (b) of the Act on the Linkage between the National Pension and Occupational Pensions.
