Enforcement Decree of the Act on the Improvement of Urban Areas and Residential Environments, Article 13 (Public Inspection by Residents for Designation of Improvement Zones)
① 정비계획의 입안권자는 법 제15조제1항에 따라 정비계획을 주민에게 공람하려는 때에는 미리 공람의 요지 및 장소를 해당 지방자치단체의 공보등에 공고하고, 공람장소에 관계 서류를 갖추어 두어야 한다.
(1) When the improvement plan drafting authority intends to make an improvement plan available for public inspection by residents under Article 15 (1) of the Act, it shall first give public notice of the gist and place of the inspection in the official gazette, etc. of the relevant local government, and shall keep the related documents at the place of inspection.
② 주민은 법 제15조제1항에 따른 공람기간 이내에 정비계획의 입안권자에게 서면(전자문서를 포함한다)으로 의견을 제출할 수 있다. <개정 2020.6.23>
(2) Residents may submit their opinions in writing (including electronic documents) to the improvement plan drafting authority within the inspection period under Article 15 (1) of the Act.
③ 정비계획의 입안권자는 제2항에 따라 제출된 의견을 심사하여 법 제15조제1항에 따라 채택할 필요가 있다고 인정하는 때에는 이를 채택하고, 채택하지 아니한 경우에는 의견을 제출한 주민에게 그 사유를 알려주어야 한다.
(3) The improvement plan drafting authority shall review the opinions submitted under paragraph (2) and adopt them if it finds it necessary to do so under Article 15 (1) of the Act; if they are not adopted, it shall inform the residents who submitted them of the reasons.
④ 법 제15조제3항에서 "대통령령으로 정하는 경미한 사항을 변경하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2022.12.9, 2023.12.5, 2024.12.17, 2025.4.29>
(4) "Where minor matters prescribed by Presidential Decree are changed" in Article 15 (3) of the Act means any of the following cases:
1. 정비구역의 면적을 10퍼센트 미만의 범위에서 변경하는 경우(법 제18조에 따라 정비구역을 분할, 통합 또는 결합하는 경우를 제외한다)
1. Where the area of an improvement zone is changed by less than 10 percent (excluding where improvement zones are divided, merged, or combined under Article 18 of the Act);
1의2. 토지등소유자 유형별 분담금 추산액 및 산출근거를 변경하는 경우
1-2. Where the estimated contributions by type of owner of land, etc. and the basis for their calculation are changed;
2. 정비기반시설의 위치를 변경하는 경우와 정비기반시설 규모를 10퍼센트 미만의 범위에서 변경하는 경우
2. Where the location of improvement infrastructure is changed, or the size of improvement infrastructure is changed by less than 10 percent;
3. 공동이용시설 설치계획을 변경하는 경우
3. Where the installation plan for common-use facilities is changed;
4. 재난방지에 관한 계획을 변경하는 경우
4. Where the plan for disaster prevention is changed;
5. 정비사업시행 예정시기를 3년의 범위에서 조정하는 경우
5. Where the expected time for implementing the improvement project is adjusted by up to three years;
6. 「건축법 시행령」 별표 1 각 호의 용도범위에서 건축물의 주용도(해당 건축물의 가장 넓은 바닥면적을 차지하는 용도를 말한다. 이하 같다)를 변경하는 경우
6. Where the main use of a building (meaning the use occupying the largest floor area of the building; the same shall apply hereinafter) is changed within the range of uses in each subparagraph of Attached Table 1 of the Enforcement Decree of the Building Act;
7. 건축물의 건폐율 또는 용적률을 축소하거나 10퍼센트 미만의 범위에서 확대하는 경우
7. Where the building coverage ratio or floor area ratio of a building is reduced, or increased by less than 10 percent;
8. 건축물의 최고 높이를 변경하는 경우
8. Where the maximum height of buildings is changed;
9. 법 제66조제1항에 따라 용적률을 완화하여 변경하는 경우
9. Where the floor area ratio is relaxed and changed under Article 66 (1) of the Act;
10. 「국토의 계획 및 이용에 관한 법률」 제2조제3호에 따른 도시ㆍ군기본계획, 같은 조 제4호에 따른 도시ㆍ군관리계획 또는 기본계획의 변경에 따라 정비계획을 변경하는 경우
10. Where the improvement plan is changed following a change in the urban/Gun master plan under Article 2, subparagraph 3 of the National Land Planning and Utilization Act, the urban/Gun management plan under subparagraph 4 of the same Article, or the basic plan;
11. 「도시교통정비 촉진법」에 따른 교통영향평가 등 관계법령에 의한 심의결과에 따른 변경인 경우
11. Where the change follows the results of deliberation under relevant statutes, such as the traffic impact assessment under the Urban Traffic Readjustment Promotion Act;
11의2. 「공공주택 특별법」에 따른 공공주택의 세부 유형을 변경하는 경우
11-2. Where the detailed type of public housing under the Special Act on Public Housing is changed;
11의3. 법 제23조제1항제2호에 따른 방법으로 시행하는 주거환경개선사업의 경우로서 법 제24조에 따른 사업시행자로 예정된 자를 변경하는 경우
11-3. For a residential environment improvement project implemented by the method under Article 23 (1) 2 of the Act, where the person expected to be the project implementer under Article 24 of the Act is changed;
11의4. 제1호, 제2호부터 제8호까지, 제10호, 제11호, 제11호의2 및 제11호의3과 유사한 사항으로서 정비계획에서 경미한 사항으로 결정한 사항을 변경하는 경우
11-4. Where matters similar to those in subparagraph 1, subparagraphs 2 through 8, 10, 11, 11-2, and 11-3, which were determined in the improvement plan to be minor matters, are changed;
12. 그 밖에 제1호, 제2호부터 제8호까지, 제10호, 제11호, 제11호의2 및 제11호의3과 유사한 사항으로서 시ㆍ도조례로 정하는 사항을 변경하는 경우
12. Where other matters similar to those in subparagraph 1, subparagraphs 2 through 8, 10, 11, 11-2, and 11-3, as prescribed by Si/Do ordinance, are changed.
