Monopoly Regulation and Fair Trade Act, Article 130 (Administrative Fines)

① 사업자, 사업자단체, 공시대상기업집단에 속하는 회사를 지배하는 동일인 또는 그 동일인의 특수관계인인 공익법인이 다음 각 호의 어느 하나에 해당하는 경우에는 1억원 이하, 회사ㆍ사업자단체ㆍ공익법인의 임원 또는 종업원, 그 밖의 이해관계인이 다음 각 호의 어느 하나에 해당하는 경우에는 1천만원 이하의 과태료를 부과한다.

1. 제11조제1항, 제2항 또는 제6항에 따른 기업결합의 신고를 하지 아니하거나 거짓의 신고를 한 자 또는 같은 조 제8항을 위반한 자

7. 제87조제2항에 따른 자료제출 요구에 대하여 정당한 이유 없이 자료를 제출하지 아니하거나 거짓의 자료를 제출한 자

② 제66조를 위반하여 질서유지의 명령을 따르지 아니한 사람에게는 100만원 이하의 과태료를 부과한다.

③ 제1항 또는 제2항에 따른 과태료는 대통령령으로 정하는 바에 따라 공정거래위원회가 부과ㆍ징수한다. 이 경우 제1항제4호에 따른 과태료는 공정거래위원회가 시정 여부, 위반의 정도, 위반의 동기 및 그 결과 등을 고려하여 대통령령으로 정하는 기준에 따라 면제할 수 있다. <개정 2024.2.6>
