자본시장과 금융투자업에 관한 법률 제388조(시장에서의 거래자격)

① 거래소의 회원이 아닌 자는 증권시장 및 파생상품시장에서의 매매거래를 하여서는 아니 된다. 다만, 회원관리규정에서 특정한 증권의 매매거래를 할 수 있도록 정한 경우에는 그 특정한 증권의 매매거래를 할 수 있다.

② 제1항 단서에 따라 증권시장에서 매매거래를 할 수 있게 된 자는 제377조제8호, 제387조, 제389조, 제394조, 제395조, 제396조제2항, 제397조부터 제400조까지, 제404조 및 제426조제6항을 적용함에 있어서 이를 거래소의 회원으로 본다.
