Financial Investment Services and Capital Markets Act, Article 6 (Financial Investment Business)

① 이 법에서 "금융투자업"이란 이익을 얻을 목적으로 계속적이거나 반복적인 방법으로 행하는 행위로서 다음 각 호의 어느 하나에 해당하는 업(業)을 말한다.

② 이 법에서 "투자매매업"이란 누구의 명의로 하든지 자기의 계산으로 금융투자상품의 매도ㆍ매수, 증권의 발행ㆍ인수 또는 그 청약의 권유, 청약, 청약의 승낙을 영업으로 하는 것을 말한다.

③ 이 법에서 "투자중개업"이란 누구의 명의로 하든지 타인의 계산으로 금융투자상품의 매도ㆍ매수, 그 중개나 청약의 권유, 청약, 청약의 승낙 또는 증권의 발행ㆍ인수에 대한 청약의 권유, 청약, 청약의 승낙을 영업으로 하는 것을 말한다. <개정 2013.5.28>

④ 이 법에서 "집합투자업"이란 집합투자를 영업으로 하는 것을 말한다.

⑤ 제4항에서 "집합투자"란 2인 이상의 투자자로부터 모은 금전등을 투자자로부터 일상적인 운용지시를 받지 아니하면서 재산적 가치가 있는 투자대상자산을 취득ㆍ처분, 그 밖의 방법으로 운용하고 그 결과를 투자자에게 배분하여 귀속시키는 것을 말한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우를 제외한다. <개정 2013.5.28, 2018.3.27>

1. 대통령령으로 정하는 법률에 따라 사모(私募)의 방법으로 금전등을 모아 운용ㆍ배분하는 것으로서 대통령령으로 정하는 투자자의 총수가 대통령령으로 정하는 수 이하인 경우

2. 「자산유동화에 관한 법률」 제3조의 자산유동화계획에 따라 금전등을 모아 운용ㆍ배분하는 경우

⑥ 제5항 각 호 외의 부분 본문에도 불구하고 다음 각 호의 어느 하나에 해당하는 자로부터 위탁받은 금전등을 그 자로부터 일상적인 운용지시를 받지 아니하면서 재산적 가치가 있는 투자대상자산을 취득ㆍ처분, 그 밖의 방법으로 운용하고 그 결과를 그 자에게 귀속시키는 행위는 집합투자로 본다. <신설 2018.3.27, 2021.12.21>

⑩ 이 법에서 "전담중개업무"란 제9조제19항제2호에 따른 일반 사모집합투자기구, 그 밖에 대통령령으로 정하는 투자자(이하 이 조 및 제77조의3에서 "일반 사모집합투자기구등"이라 한다)에 대하여 다음 각 호의 어느 하나에 해당하는 업무를 효율적인 신용공여와 담보관리 등을 위하여 대통령령으로 정하는 방법에 따라 연계하여 제공하는 업무를 말한다. <신설 2013.5.28, 2015.7.24, 2018.3.27, 2021.4.20>
