개인정보 보호법 시행령 제34조의2(개인정보 보호 인증의 기준ㆍ방법ㆍ절차 등)

① 보호위원회는 제30조제1항 각 호의 사항을 고려하여 개인정보 보호의 관리적ㆍ기술적ㆍ물리적 보호대책의 수립 등을 포함한 법 제32조의2제1항에 따른 인증의 기준을 정하여 고시한다. <개정 2017.7.26, 2020.8.4, 2023.9.12>

② 법 제32조의2제1항에 따라 개인정보 보호 인증을 받으려는 자(이하 이 조 및 제34조의3에서 "신청인"이라 한다)는 다음 각 호의 사항이 포함된 개인정보 보호 인증신청서(전자문서로 된 신청서를 포함한다)를 제34조의6에 따른 개인정보 보호 인증 전문기관(이하 "인증기관"이라 한다)에 제출하여야 한다. <개정 2024.3.12, 2026.9.10>

(2) A어 person퍼슨 who후 intends인텐즈 to투 obtain어브테인 personal퍼시늘 information인^f퍼메이션 protection프^r러텍션 certification서터^f퍼케이션 under언더 Article아터클 32-2 (1) of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 an앤 "applicant"애플리컨트 in인 this^ð디스 Article아터클 and앤드 Article아터클 34-3) shall섈 submit서브밋 to투 the^ð더 specialized스페셜라이즈드 personal퍼시늘 information인^f퍼메이션 protection프^r러텍션 certification서터^f퍼케이션 institution인스티투션 under언더 Article아터클 34-6 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 a어 "certification서터^f퍼케이션 institution")인스티투션 an앤 application애플러케이션 for^f포 personal퍼시늘 information인^f퍼메이션 protection프^r러텍션 certification서터^f퍼케이션 (including인클루딩 an앤 application애플러케이션 in인 the^ð더 form^f폼 of어^v브 an앤 electronic일렉트^r라닉 document)다큐멘트 that^ð댓 contains컨테인즈 the^ð더 following:^f팔로잉

③ 인증기관은 제2항에 따른 인증신청서를 받은 경우에는 신청인과 인증의 범위 및 일정 등에 관하여 협의하여야 한다.

(3) Upon어판 receiving^r러시^v빙 an앤 application애플러케이션 for^f포 certification서터^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 certification서터^f퍼케이션 institution인스티투션 shall섈 consult컨설트 with위^ð드 the^ð디 applicant애플리컨트 on안 the^ð더 scope,스코우프 schedule,스케줄 etc.엣세터^r러 of어^v브 the^ð더 certification.서터^f퍼케이션

④ 법 제32조의2제1항에 따른 개인정보 보호 인증심사는 제34조의8에 따른 개인정보 보호 인증심사원이 서면심사 또는 현장심사의 방법으로 실시한다.

(4) The^ð더 personal퍼시늘 information인^f퍼메이션 protection프^r러텍션 certification서터^f퍼케이션 audit오딧 under언더 Article아터클 32-2 (1) of어^v브 the^ð디 Act액트 shall섈 be비 conducted컨덕티드 by바이 personal퍼시늘 information인^f퍼메이션 protection프^r러텍션 certification서터^f퍼케이션 auditors아더터즈 under언더 Article아터클 34-8, by바이 means민즈 of어^v브 a어 document다큐멘트 review^r리^v뷰 or오 an앤 on-site안-사잇 audit.오딧

⑤ 인증기관은 제4항에 따른 인증심사의 결과를 심의하기 위하여 정보보호에 관한 학식과 경험이 풍부한 사람을 위원으로 하는 인증위원회를 설치ㆍ운영하여야 한다.

(5) In인 order오더 to투 deliberate딜리버^r럿 on안 the^ð더 results^r리절츠 of어^v브 certification서터^f퍼케이션 audits아덧츠 under언더 paragraph패^r러그^r래^f프 (4), the^ð더 certification서터^f퍼케이션 institution인스티투션 shall섈 establish이스태블리시 and앤드 operate아퍼^r레잇 a어 certification서터^f퍼케이션 committee커미티 whose후즈 members멤버즈 are아 persons퍼슨즈 with위^ð드 extensive익스텐시^v브 knowledge날러지 and앤드 experience익스피^r리언스 in인 information인^f퍼메이션 protection.프^r러텍션

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 인증신청, 인증심사, 인증위원회의 설치ㆍ운영 및 인증서의 발급 등 개인정보 보호 인증에 필요한 세부사항은 보호위원회가 정하여 고시한다. <개정 2017.7.26, 2020.8.4>
