국민건강보험법 시행령 제77조(임의계속가입자 적용기간)

① 법 제110조제2항 본문에서 "대통령령으로 정하는 기간"이란 사용관계가 끝난 날의 다음 날부터 기산(起算)하여 36개월이 되는 날을 넘지 아니하는 범위에서 다음 각 호의 구분에 따른 기간을 말한다.

② 「의료급여법」 제3조제1항제2호에 따른 수급권자가 되어 법 제10조제1항제5호에 따라 가입자의 자격이 상실된 임의계속가입자가 법 제8조제1항제1호에 따라 가입자의 자격을 다시 취득한 경우로서 다시 취득한 날이 제1항에 따른 사용관계가 끝난 날의 다음 날부터 36개월 이내이면 공단이 정하는 기간 안에 임의계속가입의 재적용을 신청할 수 있다. 이 경우 신청자는 가입자의 자격을 다시 취득한 날부터 제1항에 따른 기간 동안 임의계속가입자로서의 자격을 유지한다.

③ 제2항에서 규정한 사항 외에 임의계속가입의 재적용 신청에 필요한 신청기간, 절차, 방법 등은 공단이 정하는 바에 따른다.
