국토의 계획 및 이용에 관한 법률 시행령 제38조(공동구의 설치비용 등)

①법 제44조제5항 전단에 따른 공동구의 설치에 필요한 비용은 다음 각 호와 같다. 다만, 법 제44조제6항에 따른 보조금이 있는 때에는 그 보조금의 금액을 공제하여야 한다. <개정 2010.7.9>

② 법 제44조제5항 후단에 따라 공동구 점용예정자가 부담하여야 하는 공동구 설치비용은 해당 시설을 개별적으로 매설할 때 필요한 비용으로 하되, 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수(이하 제39조 및 제39조의3에서 "공동구관리자"라 한다)가 공동구협의회의 심의를 거쳐 해당 공동구의 위치, 규모 및 주변 여건 등을 고려하여 정한다. <개정 2010.7.9, 2012.4.10>

③사업시행자는 공동구의 설치가 포함되는 개발사업의 실시계획인가등이 있은 후 지체 없이 공동구 점용예정자에게 제1항 및 제2항에 따라 산정된 부담금의 납부를 통지하여야 한다. <개정 2010.7.9>

④제3항에 따른 부담금의 납부통지를 받은 공동구 점용예정자는 공동구설치공사가 착수되기 전에 부담액의 3분의 1 이상을 납부하여야 하며, 그 나머지 금액은 제37조제1항제1호에 따른 점용공사기간 만료일(만료일전에 공사가 완료된 경우에는 그 공사의 완료일을 말한다)전까지 납부하여야 한다. <개정 2010.7.9>
