기초연금법 시행령 제11조(감액에 따른 기초연금액 지급수준)

① 법 제8조제2항에 따라 소득인정액과 기초연금액을 합산한 금액이 선정기준액을 초과하는 사람에 대해서는 법 제5조, 제5조의2, 제6조 및 제7조에 따라 계산된 기초연금액을 상한으로 다음 각 호의 구분에 따른 금액을 지급한다. <개정 2018.8.28, 2019.3.26>

② 제1항에도 불구하고 본인 및 배우자가 모두 기초연금 수급권자로서 본인 및 배우자의 소득인정액과 법 제8조제1항에 따라 감액한 본인 및 배우자의 기초연금액을 더한 금액이 선정기준액을 넘는 본인 및 배우자에 대해서는 법 제8조제1항에 따라 감액한 본인 및 배우자의 기초연금액을 합산한 금액을 상한으로 다음 각 호의 구분에 따른 금액을 지급한다. <개정 2018.8.28>

③ 법 제8조제3항에 따라 법 제5조의2에 해당하는 기초연금 수급권자의 소득인정액과 기초연금액을 더한 금액이 저소득자 선정기준액과 법 제5조의2에 해당하지 않는 기초연금 수급권자의 기준연금액을 더한 금액을 초과하는 경우에는 해당 기초연금 수급권자의 기초연금액에서 그 초과분을 뺀 금액을 지급한다. <신설 2019.3.26>

④ 제3항에도 불구하고 본인 및 배우자가 모두 법 제5조의2에 해당하는 기초연금 수급권자로서 본인 및 배우자의 소득인정액과 법 제8조제1항에 따라 감액한 본인 및 배우자의 기초연금액을 합산한 금액을 모두 더한 금액이 저소득자 선정기준액과 법 제5조의2에 해당하지 않는 기초연금 수급권자의 기준연금액에 100분의 160을 곱한 금액을 더한 금액을 초과하는 경우에는 해당 본인 및 배우자의 기초연금액을 합산한 금액에서 그 초과분을 뺀 금액을 지급한다. <신설 2019.3.26>

⑤ 제2항 또는 제4항에 따라 지급하는 금액은 법 제8조제1항에 따라 감액한 본인 및 배우자의 기초연금액에 비례하도록 배분하여 본인 및 배우자에게 각각 지급한다. 다만, 제2항에 따라 본인과 배우자 중 1명에게 지급하는 금액이 기준연금액의 100분의 10 미만이 되는 경우에는 제2항에도 불구하고 기준연금액의 100분의 10에 해당하는 금액을 지급한다. <개정 2018.8.28, 2019.3.26>
