아동ㆍ청소년의 성보호에 관한 법률 제42조(피해아동ㆍ청소년 등에 대한 보호처분의 판결 등)

① 법원은 제41조에 따른 보호처분의 청구가 이유 있다고 인정할 때에는 6개월의 범위에서 기간을 정하여 판결로 보호처분을 선고하여야 한다.

③ 검사는 제1항에 따른 보호처분 기간의 연장이 필요하다고 인정하는 경우 법원에 그 기간의 연장을 청구할 수 있다. 이 경우 보호처분 기간의 연장 횟수는 3회 이내로 하고, 연장기간은 각각 6개월 이내로 한다.

④ 보호처분 청구사건의 판결은 아동ㆍ청소년대상 성범죄 사건의 판결과 동시에 선고하여야 한다.

⑤ 피해자 또는 법정대리인은 제41조제1호 및 제2호의 보호처분 후 주거 등을 옮긴 때에는 관할 법원에 보호처분 결정의 변경을 신청할 수 있다.

⑥ 법원은 제1항에 따른 보호처분을 결정한 때에는 검사, 피해자, 가해자, 보호관찰관 및 보호처분을 위탁받아 행하는 보호시설의 장에게 각각 통지하여야 한다. 다만, 보호시설이 민간에 의하여 운영되는 기관인 경우에는 그 시설의 장으로부터 수탁에 대한 동의를 받아야 한다.

⑦ 보호처분 결정의 집행에 관하여 필요한 사항은 「가정폭력범죄의 처벌 등에 관한 특례법」 제43조를 준용한다.
