Enforcement Decree of the National Land Planning and Utilization Act, Article 81 (Building Restrictions in Mixed-Use Districts)
법 제76조제5항제1호의3에 따라 복합용도지구에서는 해당 용도지역에서 허용되는 건축물 외에 다음 각 호에 따른 건축물 중 도시ㆍ군계획조례가 정하는 건축물을 건축할 수 있다. <개정 2025.8.26>
Under Article 76 (5) 1-3 of the Act, in a mixed-use district, in addition to the buildings permitted in the relevant use zone, buildings prescribed by an urban or Gun planning ordinance may be constructed among the buildings under the following subparagraphs:
1. 일반주거지역: 준주거지역에서 허용되는 건축물. 다만, 다음 각 목의 건축물은 제외한다.
1. General residential zone: buildings permitted in a semi-residential zone. However, the following buildings are excluded:
가. 「건축법 시행령」 별표 1 제4호의 제2종 근린생활시설 중 안마시술소
(a) Massage parlors among Class II neighborhood living facilities under subparagraph 4 of attached Table 1 of the Enforcement Decree of the Building Act;
나. 「건축법 시행령」 별표 1 제5호다목의 관람장
(b) Spectator facilities under subparagraph 5 (c) of attached Table 1 of the Enforcement Decree of the Building Act;
다. 「건축법 시행령」 별표 1 제17호의 공장
(c) Factories under subparagraph 17 of attached Table 1 of the Enforcement Decree of the Building Act;
라. 「건축법 시행령」 별표 1 제19호의 위험물 저장 및 처리 시설
(d) Facilities for storing and treating hazardous materials under subparagraph 19 of attached Table 1 of the Enforcement Decree of the Building Act;
마. 「건축법 시행령」 별표 1 제21호의 동물 및 식물 관련 시설
(e) Animal and plant-related facilities under subparagraph 21 of attached Table 1 of the Enforcement Decree of the Building Act;
바. 「건축법 시행령」 별표 1 제28호의 장례시설
(f) Funeral facilities under subparagraph 28 of attached Table 1 of the Enforcement Decree of the Building Act;
2. 일반공업지역: 준공업지역에서 허용되는 건축물. 다만 다음 각 목의 건축물은 제외한다.
2. General industrial zone: buildings permitted in a semi-industrial zone. However, the following buildings are excluded:
가. 「건축법 시행령」 별표 1 제2호가목의 아파트
(a) Apartments under subparagraph 2 (a) of attached Table 1 of the Enforcement Decree of the Building Act;
나. 「건축법 시행령」 별표 1 제4호의 제2종 근린생활시설 중 단란주점 및 안마시술소
(b) Karaoke bars and massage parlors among Class II neighborhood living facilities under subparagraph 4 of attached Table 1 of the Enforcement Decree of the Building Act;
다. 「건축법 시행령」 별표 1 제11호의 노유자시설
(c) Facilities for the elderly and children under subparagraph 11 of attached Table 1 of the Enforcement Decree of the Building Act;
3. 계획관리지역: 다음 각 목의 어느 하나에 해당하는 건축물
3. Planned management zone: buildings falling under any of the following items:
가. 「건축법 시행령」 별표 1 제4호의 제2종 근린생활시설 중 일반음식점ㆍ휴게음식점ㆍ제과점(별표 20 제1호라목에 따라 건축할 수 없는 일반음식점ㆍ휴게음식점ㆍ제과점은 제외한다)
(a) General restaurants, rest restaurants and bakeries among Class II neighborhood living facilities under subparagraph 4 of attached Table 1 of the Enforcement Decree of the Building Act (excluding general restaurants, rest restaurants and bakeries that may not be built under subparagraph 1 (d) of attached Table 20);
나. 「건축법 시행령」 별표 1 제7호의 판매시설
(b) Sales facilities under subparagraph 7 of attached Table 1 of the Enforcement Decree of the Building Act;
다. 「건축법 시행령」 별표 1 제15호의 숙박시설(별표 20 제1호사목에 따라 건축할 수 없는 숙박시설은 제외한다)
(c) Lodging facilities under subparagraph 15 of attached Table 1 of the Enforcement Decree of the Building Act (excluding lodging facilities that may not be built under subparagraph 1 (g) of attached Table 20);
라. 「건축법 시행령」 별표 1 제16호다목의 테마파크업의 시설, 그 밖에 이와 비슷한 시설
(d) Facilities for the theme park business under subparagraph 16 (c) of attached Table 1 of the Enforcement Decree of the Building Act, and other similar facilities.
