Enforcement Decree of the Act on Registration of Credit Business and Protection of Finance Users, Article 11-3 (Entrustment of Duties)
①시ㆍ도지사등은 법 제18조의7제1항 및 제2항에 따라 법 제3조의4에 따른 대부업등의 준수사항 등에 관한 교육 업무를 협회에 위탁한다. <개정 2016.7.6>
(1) Pursuant to Article 18-7 (1) and (2) of the Act, the Si/Do Governor, etc. entrusts the Association with duties concerning education on matters to be observed in credit business, etc. under Article 3-4 of the Act.
② 금융위원회는 법 제18조의7제2항에 따라 다음 각 호의 업무를 금융감독원장에게 위탁한다. <신설 2016.7.6, 2017.10.17, 2018.11.13, 2025.7.21>
(2) Pursuant to Article 18-7 (2) of the Act, the Financial Services Commission entrusts the following duties to the Governor of the Financial Supervisory Service:
1. 법 제3조ㆍ제3조의2 및 제3조의3에 따른 대부업등의 등록, 등록갱신, 등록증의 반납과 등록증의 분실신고 접수 등의 절차에 관한 업무
1. Duties concerning procedures such as registration, renewal of registration, return of certificates of registration, and receipt of reports of loss of certificates of registration for credit business, etc. under Articles 3, 3-2, and 3-3 of the Act;
2. 법 제3조의5에 따른 대부업등의 등록요건 심사에 관한 업무
2. Duties concerning examination of registration requirements for credit business, etc. under Article 3-5 of the Act;
3. 법 제4조제1항 및 제2항에 따른 대부업자등의 임원 및 업무총괄 사용인의 자격심사에 관한 업무
3. Duties concerning examination of the qualifications of officers and business-supervising employees of credit business operators, etc. under Article 4 (1) and (2) of the Act;
4. 법 제5조에 따른 대부업등의 변경등록 및 폐업신고 접수에 관한 업무
4. Duties concerning receipt of registration of changes and reports of closure of credit business, etc. under Article 5 of the Act;
5. 법 제10조제2항에 따른 상호출자제한기업집단 대부업자의 신용공여 사실에 관한 보고의 접수
5. Receipt of reports on the extension of credit by credit business operators belonging to business groups subject to limitation on cross-shareholding under Article 10 (2) of the Act;
6. 법 제10조제5항에 따른 세부계획서의 접수
6. Receipt of detailed plans under Article 10 (5) of the Act;
7. 법 제10조제8항에 따른 신용공여한도 위반 혐의 대부업자 및 그 대주주에 대한 자료제출명령
7. Orders to submit materials to credit business operators suspected of violating credit extension limits and to their major shareholders under Article 10 (8) of the Act;
7의2. 법 제11조의2제5항에 따른 시정명령 심사에 관한 업무
7-2. Duties concerning examination of corrective orders under Article 11-2 (5) of the Act;
8. 법 제12조제1항에 따른 대부업자등의 업무 및 업무와 관련된 재산에 관한 보고, 자료의 제출 및 그 밖에 필요한 명령
8. Reports on the business of credit business operators, etc. and property related to the business, submission of materials, and other necessary orders under Article 12 (1) of the Act;
8의2. 법 제12조제7항에 따른 시정명령 심사에 관한 업무
8-2. Duties concerning examination of corrective orders under Article 12 (7) of the Act;
9. 법 제12조제9항에 따른 보고서의 접수
9. Receipt of reports under Article 12 (9) of the Act;
10. 법 제13조제6항제1호 및 제3호에 따른 조치
10. Measures under Article 13 (6) 1 and 3 of the Act;
10의2. 법 제13조제7항에 따른 조치 내용의 결정 및 통보(같은 조 제6항제1호 및 제3호에 해당하는 조치를 받았을 것으로 인정되는 경우의 조치 내용의 결정 및 통보에 한정한다)
10-2. Determination and notification of the content of measures under Article 13 (7) of the Act (limited to the determination and notification of the content of measures where it is recognized that measures falling under paragraph (6) 1 and 3 of the same Article have been taken);
10의3. 법 제15조제4항에 따른 시정명령 심사에 관한 업무
10-3. Duties concerning examination of corrective orders under Article 15 (4) of the Act;
11. 법 제16조에 따른 대부업자의 실태조사 등에 관한 업무
11. Duties concerning fact-finding surveys of credit business operators, etc. under Article 16 of the Act;
12. 법 제16조의2에 따른 행정처분 사실 등의 공개에 관한 업무
12. Duties concerning disclosure of administrative dispositions, etc. under Article 16-2 of the Act;
13. 법 제17조제1항에 따른 등록수수료에 관한 업무
13. Duties concerning registration fees under Article 17 (1) of the Act;
14. 법 제18조의8에 따른 대부업자등의 관리ㆍ감독 등을 위하여 사실확인이 필요한 경우 관계 기관에의 협조 요청
14. Requests for cooperation to relevant agencies where fact-finding is necessary for managing and supervising credit business operators, etc. under Article 18-8 of the Act.
