Enforcement Decree of the Act on the Control of Narcotics, etc., Article 28-2 (Processing of Sensitive Information and Personally Identifiable Information)
보건복지부장관, 식품의약품안전처장(제8조제1항 또는 제28조에 따라 식품의약품안전처장의 업무를 위탁받거나 권한을 위임받은 자를 포함한다), 지방식품의약품안전청장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다) 또는 법 제40조제1항에 따른 치료보호기관(제9호 및 제10호의 사무만 해당한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보(이하 "건강정보"라 한다), 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보(이하 "범죄경력정보"라 한다), 같은 영 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. 다만, 제4호, 제5호, 제7호 및 제16호의 사무의 경우에는 건강정보와 범죄경력정보는 제외하고, 제6호의2의 사무의 경우에는 범죄경력정보는 제외한다. <개정 2013.3.23, 2019.3.12, 2019.12.10, 2020.9.22, 2022.12.20, 2024.1.30>
The Minister of Health and Welfare, the Minister of Food and Drug Safety (including a person entrusted with the affairs or delegated the authority of the Minister of Food and Drug Safety under Article 8 (1) or 28), the head of a regional food and drug safety office, a Mayor/Do Governor, or the head of a Si/Gun/Gu (including a person to whom the authority has been delegated or entrusted, if the authority has been delegated or entrusted), or a treatment and protection institution under Article 40 (1) of the Act (limited to the affairs in subparagraphs 9 and 10), may, where inevitable for performing any of the following affairs, process data containing information on health under Article 23 of the Personal Information Protection Act (hereinafter referred to as "health information"), information constituting criminal record data under Article 18, subparagraph 2 of the Enforcement Decree of that Act (hereinafter referred to as "criminal record information"), or resident registration numbers, passport numbers, or alien registration numbers under Article 19, subparagraph 1, 2, or 4 of that Decree: Provided, That health information and criminal record information are excluded for the affairs in subparagraphs 4, 5, 7, and 16, and criminal record information is excluded for the affairs in subparagraph 6-2:

1. Affairs concerning approval of the sale of cannabis under the proviso of Article 3, subparagraph 7 of the Act and Article 3 (3) 4 of this Decree;

1-2. Affairs concerning the prohibition of handling of narcotics by persons who are not narcotics handlers under Article 4 of the Act;

2. Affairs concerning permission for narcotics handlers under Article 6 of the Act;
3. 법 제6조의2에 따른 원료물질의 수출입업 또는 제조업의 허가 등에 관한 사무
