사립학교법 제74조(과태료)
Private School Act, Article 74 (Administrative Fines)
① 사립학교 교원 또는 제70조의2에 따라 임명된 사무직원의 임용권자가 다음 각 호의 어느 하나에 해당하는 경우에는 1천만원 이하의 과태료를 부과한다. <개정 2021.9.24>
(1) Where the appointing authority of teachers at a private school or of office staff appointed under Article 70-2 falls under any of the following, an administrative fine not exceeding ten million won shall be imposed:
1. 제54조제3항 후단을 위반하여 특별한 사유 없이 관할청의 해임 또는 징계 요구를 따르지 아니한 경우
1. Where, in violation of the latter part of Article 54 (3), it fails to comply with the competent authority's request for removal from office or disciplinary action without a special reason;
2. 제54조의2제1항 후단을 위반하여 특별한 사유 없이 관할청의 해임 요구를 따르지 아니한 경우
2. Where, in violation of the latter part of Article 54-2 (1), it fails to comply with the competent authority's request for removal from office without a special reason;
3. 제66조의2제3항을 위반하여 재심의를 요구하지 아니한 경우
3. Where it fails to request reconsideration in violation of Article 66-2 (3);
4. 제66조의2제5항 전단(제70조의6제5항에서 준용하는 경우를 포함한다)을 위반하여 의결 내용에 따라 징계처분을 하지 아니한 경우
4. Where, in violation of the former part of Article 66-2 (5) (including where it applies mutatis mutandis under Article 70-6 (5)), it fails to take disciplinary action according to the decision;
5. 제70조의5제3항 후단을 위반하여 특별한 사유 없이 관할청의 징계의결 요구에 따르지 아니한 경우
5. Where, in violation of the latter part of Article 70-5 (3), it fails to comply with the competent authority's requirement to request a disciplinary decision without a special reason;
6. 제70조의6제3항을 위반하여 재심의를 요구하지 아니한 경우
6. Where it fails to request reconsideration in violation of Article 70-6 (3);
7. 제70조의7제1항 각 호 외의 부분 후단을 위반하여 특별한 사유 없이 관할청의 해임 요구를 따르지 아니한 경우
7. Where, in violation of the latter part of the part of Article 70-7 (1) other than its subparagraphs, it fails to comply with the competent authority's request for removal from office without a special reason;
8. 제72조의5제4항제2호에 따른 관할청의 시정명령을 특별한 사유 없이 따르지 아니한 경우
8. Where it fails to comply with a corrective order of the competent authority under Article 72-5 (4) 2 without a special reason.
② 학교법인의 이사장, 감사 또는 청산인이나 사립학교경영자(법인인 경우에는 그 대표자 또는 이사)가 다음 각 호의 어느 하나에 해당하는 경우에는 500만원 이하의 과태료를 부과한다. <개정 2021.8.10, 2021.9.24>
(2) Where the chairperson of the board, an auditor, or a liquidator of a school foundation, or a private school operator (or, if it is a corporation, its representative or director), falls under any of the following, an administrative fine not exceeding five million won shall be imposed:
1. 이 법에 따른 등기를 하지 아니한 경우
1. Where he or she fails to make a registration required under this Act;
2. 제6조제3항에 따른 공고를 하지 아니하거나 공고하여야 할 사항을 거짓으로 공고하거나 누락하여 공고한 경우
2. Where he or she fails to make a public announcement under Article 6 (3), or makes a false or incomplete announcement of the matters to be announced;
3. 제13조에 따라 준용되는 「민법」 제55조제1항에 따른 재산목록 또는 제32조(제51조에 따라 준용되는 경우를 포함한다) 및 제37조제1항에 따른 재산목록이나 그 밖의 서류를 갖추어 두지 아니하거나 이에 적을 사항을 거짓으로 적거나 누락하여 적은 경우
3. Where he or she fails to keep the property inventory under Article 55 (1) of the Civil Act as applied mutatis mutandis under Article 13, or the property inventory or other documents under Article 32 (including where it applies mutatis mutandis under Article 51) and Article 37 (1), or makes false or incomplete entries of the matters to be entered in them;
4. 제19조제4항제3호 또는 제48조(제51조에 따라 준용되는 경우를 포함한다)에 따른 보고를 하지 아니하거나 보고하여야 할 사항을 거짓으로 보고하거나 누락하여 보고한 경우
4. Where he or she fails to make a report under Article 19 (4) 3 or Article 48 (including where it applies mutatis mutandis under Article 51), or makes a false or incomplete report of the matters to be reported;
4의2. 제28조제5항에 따른 신고를 하지 아니한 경우
4-2. Where he or she fails to make a report under Article 28 (5);
5. 제31조(제51조에 따라 준용되는 경우를 포함한다), 제37조제2항 또는 제38조제2항을 위반한 경우
5. Where he or she violates Article 31 (including where it applies mutatis mutandis under Article 51), Article 37 (2), or Article 38 (2);
6. 제42조에 따라 준용되는 「민법」 제79조 또는 제93조제1항에 따른 파산선고의 신청을 하지 아니한 경우
6. Where he or she fails to file for a declaration of bankruptcy under Article 79 or 93 (1) of the Civil Act as applied mutatis mutandis under Article 42;
7. 제42조에 따라 준용되는 「민법」 제88조제1항 또는 제93조제1항에 따른 공고를 하지 아니하거나 공고할 사항을 거짓으로 공고하거나 누락하여 공고한 경우
7. Where he or she fails to make a public announcement under Article 88 (1) or 93 (1) of the Civil Act as applied mutatis mutandis under Article 42, or makes a false or incomplete announcement of the matters to be announced;
8. 제42조에 따라 준용되는 「민법」 제86조 또는 제94조에 따른 신고를 게을리하거나 부실한 신고를 한 경우
8. Where he or she neglects to file a report under Article 86 or 94 of the Civil Act as applied mutatis mutandis under Article 42, or files an inaccurate report;
9. 제42조에 따라 준용되는 「민법」 제90조를 위반한 경우
9. Where he or she violates Article 90 of the Civil Act as applied mutatis mutandis under Article 42;
10. 제72조의3에 따른 공개를 하지 아니하거나 거짓으로 공개한 경우
10. Where he or she fails to make a disclosure under Article 72-3 or makes a false disclosure.
③ 대학교육기관의 장 및 대학교육기관을 설치ㆍ경영하는 학교법인의 이사장이 제32조의2제5항에 따른 보고를 하지 아니하거나 보고하여야 할 사항을 거짓으로 보고하거나 누락하여 보고한 경우에는 500만원 이하의 과태료를 부과한다.
(3) Where the head of a higher education institution or the chairperson of the board of a school foundation that establishes and runs a higher education institution fails to make a report under Article 32-2 (5), or makes a false or incomplete report of the matters to be reported, an administrative fine not exceeding five million won shall be imposed.
④ 사립학교 교원의 임용권자가 제54조제1항에 따른 보고를 하지 아니하거나 거짓으로 보고한 경우에는 500만원 이하의 과태료를 부과한다.
(4) Where the appointing authority of teachers at a private school fails to make a report under Article 54 (1) or makes a false report, an administrative fine not exceeding five million won shall be imposed.
⑤ 제1항부터 제4항까지의 규정에 따른 과태료는 대통령령으로 정하는 바에 따라 관할청이 부과ㆍ징수한다.
(5) The administrative fines under paragraphs (1) through (4) shall be imposed and collected by the competent authority, as prescribed by Presidential Decree.
