의료급여법 시행령 제21조(민감정보 및 고유식별정보의 처리)
Enforcement Decree of the Medical Aid Act, Article 21 (Processing of Sensitive Information and Personally Identifiable Information)
보건복지부장관(법 제5조의2제3항 또는 이 영 제19조에 따라 보건복지부장관의 권한 또는 업무를 위임ㆍ위탁받은 자를 포함한다), 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장(제20조 또는 조례ㆍ규칙에 따라 해당 권한 또는 업무를 위임ㆍ위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제1호 또는 제2호에 따른 유전정보 또는 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2013.12.11>
Where unavoidable to perform the following affairs, the Minister of Health and Welfare (including a person to whom the Minister's authority or affairs have been delegated or entrusted under Article 5-2 (3) of the Act or Article 19 of this Decree), a Mayor/Do Governor, or the head of a Si/Gun/Gu (including a person to whom the relevant authority or affairs have been delegated or entrusted under Article 20 or an ordinance or rule) may process information on health under Article 23 of the Personal Information Protection Act, information that constitutes genetic information or criminal history records under subparagraph 1 or 2 of Article 18 of the Enforcement Decree of the same Act, and materials containing resident registration numbers or alien registration numbers under subparagraph 1 or 4 of Article 19 of the same Decree:
1. 법 제3조, 제3조의2, 제3조의3, 제4조, 제8조, 제16조 및 제17조에 따른 의료급여 수급권자 인정 등 및 변경, 중지에 관한 사무
1. Affairs concerning the recognition, etc., change, and suspension of eligible persons for medical aid under Articles 3, 3-2, 3-3, 4, 8, 16, and 17 of the Act;
2. 법 제5조제3항에 따른 수급권자 건강증진을 위하여 필요한 사업에 관한 사무
2. Affairs concerning projects necessary to promote the health of eligible persons under Article 5 (3) of the Act;
3. 법 제5조의2에 따른 사례관리에 관한 사무
3. Affairs concerning case management under Article 5-2 of the Act;
4. 법 제6조에 따른 의료급여심의위원회 운영에 관한 사무
4. Affairs concerning the operation of Medical Aid Deliberation Committees under Article 6 of the Act;
5. 법 제7조, 제9조부터 제11조까지, 제11조의2부터 제11조의4까지의 규정에 따른 의료급여, 급여비용의 청구ㆍ지급 등에 관한 사무
5. Affairs concerning medical aid and claims for and payment of medical aid costs, etc. under Articles 7, 9 through 11, and 11-2 through 11-4 of the Act;
6. 법 제12조 및 제13조에 따른 요양비 등 지원에 관한 사무
6. Affairs concerning support for medical care expenses, etc. under Articles 12 and 13 of the Act;
7. 법 제14조에 따른 건강검진에 관한 사무
7. Affairs concerning health checkups under Article 14 of the Act;
8. 법 제15조, 제19조, 제23조 및 제24조에 따른 급여의 제한, 구상권, 부당이득금의 징수 등에 관한 사무
8. Affairs concerning the restriction of medical aid, the right to indemnity, the collection of unjust enrichment, etc. under Articles 15, 19, 23, and 24 of the Act;
9. 법 제20조부터 제22조까지의 규정에 따른 대지급금에 관한 사무
9. Affairs concerning advance payments under Articles 20 through 22 of the Act;
10. 법 제26조 및 제27조에 따른 기금 및 예탁금 관리에 관한 사무
10. Affairs concerning the management of the Fund and deposits under Articles 26 and 27 of the Act;
11. 법 제28조, 제29조, 제29조의2, 제30조, 제32조, 제32조의2 및 제32조의3에 따른 의료급여기관에 대한 행정처분, 보고ㆍ검사, 자료 요청 및 포상금ㆍ장려금 지급 등에 관한 사무
11. Affairs concerning administrative dispositions against medical aid institutions, reports and inspections, requests for data, payment of rewards and incentives, etc. under Articles 28, 29, 29-2, 30, 32, 32-2, and 32-3 of the Act.
