저작권법 제104조의8(침해의 정지ㆍ예방 청구 등)

저작권, 그 밖에 이 법에 따라 보호되는 권리를 가진 자는 제104조의2부터 제104조의4까지의 규정을 위반한 자에 대하여 침해의 정지ㆍ예방, 손해배상의 담보 또는 손해배상이나 이를 갈음하는 법정손해배상의 청구를 할 수 있으며, 고의 또는 과실 없이 제104조의2제1항의 행위를 한 자에 대하여는 침해의 정지ㆍ예방을 청구할 수 있다. 이 경우 제123조, 제125조, 제125조의2, 제126조 및 제129조를 준용한다. <개정 2011.12.2>
