주택법 제55조(자료제공의 요청)

① 국토교통부장관은 제54조제2항에 따라 주택을 공급받으려는 자의 입주자자격, 주택의 소유 여부, 재당첨 제한 여부, 공급 순위 등을 확인하거나 제56조의3에 따라 요청받은 정보를 제공하기 위하여 필요하다고 인정하는 경우에는 주민등록 전산정보(주민등록번호ㆍ외국인등록번호 등 고유식별번호를 포함한다), 가족관계 등록사항, 국세, 지방세, 금융, 토지, 건물(건물등기부ㆍ건축물대장을 포함한다), 자동차, 건강보험, 국민연금, 고용보험 및 산업재해보상보험 등의 자료 또는 정보의 제공을 관계 기관의 장에게 요청할 수 있다. 이 경우 관계 기관의 장은 특별한 사유가 없으면 이에 따라야 한다. <개정 2020.1.23>

② 국토교통부장관은 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제2항에도 불구하고 제54조제2항에 따라 주택을 공급받으려는 자의 입주자자격, 공급 순위 등을 확인하기 위하여 본인, 배우자, 본인 또는 배우자와 세대를 같이하는 세대원이 제출한 동의서면을 전자적 형태로 바꾼 문서에 의하여 금융기관 등(「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등 및 「신용정보의 이용 및 보호에 관한 법률」 제25조에 따른 신용정보집중기관을 말한다. 이하 같다)의 장에게 다음 각 호의 자료 또는 정보의 제공을 요청할 수 있다. <개정 2020.1.23>

③ 국토교통부장관이 제2항에 따라 금융정보ㆍ신용정보 또는 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청하는 경우 해당 금융정보등 명의인의 정보제공에 대한 동의서면을 함께 제출하여야 한다. 이 경우 동의서면은 전자적 형태로 바꾸어 제출할 수 있으며, 금융정보등을 제공한 금융기관 등의 장은 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제1항과 「신용정보의 이용 및 보호에 관한 법률」 제35조에도 불구하고 금융정보등의 제공사실을 명의인에게 통보하지 아니할 수 있다.

④ 국토교통부장관 및 사업주체(국가, 지방자치단체, 한국토지주택공사 및 지방공사로 한정한다)는 제1항 및 제2항에 따른 자료를 확인하기 위하여 「사회복지사업법」 제6조의2제2항에 따른 정보시스템을 연계하여 사용할 수 있다.

⑤ 국토교통부 소속 공무원 또는 소속 공무원이었던 사람과 제4항에 따른 사업주체의 소속 임직원은 제1항과 제2항에 따라 얻은 정보와 자료를 이 법에서 정한 목적 외의 다른 용도로 사용하거나 다른 사람 또는 기관에 제공하거나 누설하여서는 아니 된다.
