관광진흥법 제35조(등록취소 등)

Tourism Promotion Act, Article 35 (Revocation of Registration)

① 관할 등록기관등의 장은 관광사업의 등록등을 받거나 신고를 한 자 또는 사업계획의 승인을 받은 자가 다음 각 호의 어느 하나에 해당하면 그 등록등 또는 사업계획의 승인을 취소하거나 6개월 이내의 기간을 정하여 그 사업의 전부 또는 일부의 정지를 명하거나 시설ㆍ운영의 개선을 명할 수 있다. <개정 2007.7.19, 2009.3.25, 2011.4.5, 2014.3.11, 2015.2.3, 2015.5.18, 2015.12.22, 2017.11.28, 2018.6.12, 2018.12.11, 2023.8.8, 2024.2.27, 2025.11.11>

1. 제4조에 따른 등록기준에 적합하지 아니하게 된 경우 또는 변경등록기간 내에 변경등록을 하지 아니하거나 등록한 영업범위를 벗어난 경우

1의2. 제5조제2항 및 제4항에 따라 문화체육관광부령으로 정하는 시설과 설비를 갖추지 아니하게 되는 경우

2. 제5조제3항 및 제4항 후단에 따른 변경허가를 받지 아니하거나 변경신고를 하지 아니한 경우

2의2. 제6조제2항에 따른 지정 기준에 적합하지 아니하게 된 경우

3. 제8조제4항(같은 조 제6항에 따라 준용하는 경우를 포함한다)에 따른 기한 내에 신고를 하지 아니한 경우

3의2. 제8조제8항을 위반하여 휴업 또는 폐업을 하고 알리지 아니하거나 미리 신고하지 아니한 경우

4. 제9조에 따른 보험 또는 공제에 가입하지 아니하거나 영업보증금을 예치하지 아니한 경우

4의2. 제10조제2항을 위반하여 사실과 다르게 관광표지를 붙이거나 관광표지에 기재되는 내용을 사실과 다르게 표시 또는 광고하는 행위를 한 경우

5. 제11조를 위반하여 관광사업의 시설을 타인에게 처분하거나 타인에게 경영하도록 한 경우

6. 제12조에 따른 기획여행의 실시요건 또는 실시방법을 위반하여 기획여행을 실시한 경우

7. 제14조를 위반하여 안전정보 또는 변경된 안전정보를 제공하지 아니하거나, 여행계약서 및 보험 가입 등을 증명할 수 있는 서류를 여행자에게 내주지 아니한 경우 또는 여행자의 사전 동의 없이 여행일정(선택관광 일정을 포함한다)을 변경하는 경우

8. 제15조에 따라 사업계획의 승인을 얻은 자가 정당한 사유 없이 대통령령으로 정하는 기간 내에 착공 또는 준공을 하지 아니하거나 같은 조를 위반하여 변경승인을 얻지 아니하고 사업계획을 임의로 변경한 경우

8의2. 제18조의2에 따른 준수사항을 위반한 경우

9. 제20조제1항 및 제4항을 위반하여 분양 또는 회원모집을 하거나 같은 조 제5항에 따른 소유자등ㆍ회원의 권익을 보호하기 위한 사항을 준수하지 아니한 경우

9의2. 제20조의2에 따른 준수사항을 위반한 경우

9의3. 제20조의4를 위반하여 카메라나 그 밖에 이와 유사한 기능을 갖춘 기계장치를 설치한 경우

10. 제21조에 따른 카지노업의 허가 요건에 적합하지 아니하게 된 경우

11. 제23조제3항을 위반하여 카지노 시설 및 기구에 관한 유지ㆍ관리를 소홀히 한 경우

14. 제32조에 따른 물놀이형 테마파크시설의 안전ㆍ위생기준을 지키지 아니한 경우

15. 제33조제1항에 따른 테마파크시설에 대한 안전성검사 및 안전성검사 대상에 해당되지 아니함을 확인하는 검사를 받지 아니하거나 같은 조 제2항에 따른 안전관리자를 배치하지 아니한 경우

16. 제34조제1항에 따른 영업질서 유지를 위한 준수사항을 지키지 아니하거나 같은 조 제2항을 위반하여 불법으로 제조한 부분품을 설치하거나 사용한 경우

② 관할 등록기관등의 장은 관광사업의 등록등을 받은 자가 다음 각 호의 어느 하나에 해당하면 6개월 이내의 기간을 정하여 그 사업의 전부 또는 일부의 정지를 명할 수 있다. <신설 2007.7.19, 2008.2.29, 2011.4.5, 2023.8.8>

③제1항 및 제2항에 따른 취소ㆍ정지처분 및 시설ㆍ운영개선명령의 세부적인 기준은 그 사유와 위반 정도를 고려하여 대통령령으로 정한다. <개정 2007.7.19>

④관할 등록기관등의 장은 관광사업에 사용할 것을 조건으로 「관세법」 등에 따라 관세의 감면을 받은 물품을 보유하고 있는 관광사업자로부터 그 물품의 수입면허를 받은 날부터 5년 이내에 그 사업의 양도ㆍ폐업의 신고 또는 통보를 받거나 그 관광사업자의 등록등의 취소를 한 경우에는 관할 세관장에게 그 사실을 즉시 통보하여야 한다. <개정 2007.7.19>

⑤관할 등록기관등의 장은 관광사업자에 대하여 제1항 및 제2항에 따라 등록등을 취소하거나 사업의 전부 또는 일부의 정지를 명한 경우에는 제18조제1항 각 호의 신고 또는 인ㆍ허가 등의 소관 행정기관의 장(외국인투자기업인 경우에는 재정경제부장관을 포함한다)에게 그 사실을 통보하여야 한다. <개정 2007.7.19, 2008.2.29, 2023.5.16, 2025.10.1>

⑥관할 등록기관등의 장 외의 소관 행정기관의 장이 관광사업자에 대하여 그 사업의 정지나 취소 또는 시설의 이용을 금지하거나 제한하려면 미리 관할 등록기관등의 장과 협의하여야 한다. <개정 2007.7.19>
